It's states that the bank letter does not contain the third party full address including postcode and landline telephone number.so the bank letter does not meet the criteria set out in paragraph 41 of appendix A of immigration rules

Visa Approved!

Post by yuva » Fri May 24, 2013 2:34 pm

Hey Guys,

Just received a call from my solicitor and heard my visa has been approved.

Applied on 12th Nov and completed interview on 16th April.

I've been running the business for 2 years now, so had all the documents and already invested the 50K required.

Thanks for sharing all your experiences, it helped me to stay connected during this stressful period.

I wish good luck to all of you!

Cheers

No quarry at all.

Me and my team member both have 25K in personal accounts in UK and gave consent letters to each other for use of funds. The letters were signed by a solicitor.

Reason of refusal: Only objection is that we could not have access to 50K, the consent letter not fulfill the requirement. According to UKBA, we should provide bank letters for the access of 25K in other team member also. the Uk banks not provide this type of letter.

I was given the chance of appeal, but my team member not, as he has leave to remain in Uk for more than 1 Y.

Can any one please help to clear the following points:

1-Chances of success, if i go in appeal.

2-Can i reapply after launching the appeal?

3-Can my team member claim to get a chance of appeal now?

4-If after appeal, i get visa, then how it will effect on my team member case? Can he claim visa on the grounds of my successful appeal, as the we both got refusal on the same reason, access of funds.

Best wishes fo all.
What abt ur £900 funds.?? Did u show £25k +£900 or £25 including £900 Bcz if u hv did it den u dnt hv access to £25 for ur self... U hv to show £50 as a team n £1800 for u n ur team member's Maintanance funds... Did u do dat.??
£900 are separate from 25K, no problem of maintenance funds. I have 25K in my account and my team member has 25K in his account. Each of us provided bank statements of 25+25K and consent letters to each other.

Appeal

Post by tier1enterpreneur » Sat May 25, 2013 11:46 am

Hello guys so I am going in for an appeal. I believe that will take another 5 to 6 months for the decision.
I was wondering if anyone has appealed yet and do you recommend to appeal with the solicitor's help or one can appeal by oneself.
I met a solicitor yesterday and was told the case is strong and I should defi appeal. That helped me regain little bit of confidence !!!!!
seeing another solicitor today will update soon guys !!!!!
guys to all the ppl who helped me stay strong even after the refusal.

cheers.

hi,
i got the same refusal as urs

we applied as a team psw route n money held in uk accounts. both had money held in their personal uk accounts 25 k each.

reasons for refusal:

1. no letter has been provided to prove that we both hav access to 50k so no point been awarded.
2. no landline number is provided

so wats ur plans for appeal n wat r u goin to do????

Refusal

Post by Akhan14 » Sat Jun 01, 2013 1:42 am

Applied 0n 12-12-12 as variation of leave from tier 4
125k in personal bank: Barclays Uk
75k in third party pakistan account: Allied Bank of Pakistan
bio on 1-2-13
refusal 31-5-13

Reason:
1: Bank did not mention my name on the bank letter from 3rd party..

My Defense:
As third party who hold bank account in pk was present in uk, i send uk declaration from 3rd party attested by a solicitor as well as mine for 125k in my personal account. Which in my opinion should give me 25 points?

Bank did mention money is freely transferable and disposable in uk, which should give further 50 points?

2: Bank did not mention it is regulated by FSA.

My Defense:
Third party bank "Allied Bank Of Pakistan" appears On UKBA list of a few FSA regulated banks IN Pakistan.

Now Also i know a few people who were in similar situation, had appeals and judge asked ukba for reconsidering their cases.

that means another waste of 4-6 monts?

what do u guys make of it?

Hi Fellows,
Just an update
-Applied Tier 1 (Entrepreneur) from Tier 4 (Student) on 11-12-12
-Acknowledgement received on 16-12-12
-Sent English Language certificates ESOL C1 certificate and UKNARIC report on 24-12-12.
-Biometric given on 16-01-13
- Received (Refusal) along with documents on 29-05-13.

They Awarded all points except English Language in which they awarded 0 as they havent received English Language documents which i sent on 24-12-12. According to Post office / Royal mail they received this post on 28-12-12.
Now No right of Appeal , No Admin Review etc. because i have a visa till 2015 as Tier 4 student; although my college is not in the list they didnt curtail my visa so that i cant get right of appeal.
The only option i had now is Judicial Review (High Court) and this process is quite expensive and time consuming ...Need to wait 3 to 6 months more unfortunately.     :( :( :( :( :(
