Child Benefit under Discretionary Leave - 2.5 years

Post by real-thing » Thu Sep 12, 2013 3:35 pm

Hi,

Wondering if I am eligible to claim child benefit for my child under discretionary leave which was granted this year. Child was born here.

Will this effect on my future application for extension?

I will appreciate your answer

Thanks

You appear to be on the new 10 year route to settlement under family life provisions (application decided after July 2012), confirm? If so, you should have no recourse to public funds (stated on the BRP/vignette). This would mean you cannot claim child benefit. However, do you have a partner? If so, what is his/her status? What is your native Country?

However, as you have a child you should claim the circumstances are exceptional and in the interest of the child's welfare, public funds access should be granted.
