But I didn't receive any letter about the delay,i even don't know that my application is on hold or not.

My application can't be on hold because we meet the minimum income threshold.

I meet the income requirement yet my case is on hold because the ECOs are not trained well enough for their jobs!

Ya I agree with humybe7709,we don't know what will the decision of this appeal is.so waiting till march is just wastage of time.the other thing is for example high court changes the financial rule, then for implementation home office take 2-3 more months, then ur application consider and u get ur visa, the whole process take upto 8-9 months. :(

But why would you withdraw your application if you dont even know yet if you r on hold and also if you ARE on hold, i would advise you to wait and see under what reason they have put u on hold. What if you re-apply and make same mistake again?

Don't give bad advice.

You're far more likely to win a case with a sane judge than re-applying in the hope a ECO gives you a VISA.

Believe me when I say this, it is far far better to appeal unless you have money to waste, which very few people do.

Who's to say the ECO won't reject again incorrectly on a different issue? You think it's a guarantee they'll stamp VISA on a 2nd application.

Hi Khan, just out of your general opinion when do you think the court appeal hearing will be? This year or next year?
I realize you wont know 100% but whats your observation?

Court dates are fluctuating at the moment, but at the moment it's around a 8-12 week depending on the region you're from. This is much slower than a year ago, but con-incidentally application times have been sped up since then. A lot of factors determine the date given.

Withdrawing your application will not help you,

Even if u reapply it could take another 6 months, you have been patient for so long just a little bit more.

Guys if ur applications are on hold Think about leaving the application on hold and getting ur partner over on a visit visa.. Thats what I'm thinking now. U can request to have ur passport back whilst application remains on hold. This is the only way to be together whilst the government wastes our time

Hi Everyone,

I have been a silent member on this forum for over a year. The forum has helped me through a lot and given me a something to turn to in my wait for my wifes visa. I just wanted to share my timeline so other people can see that there not the only ones there's loads of us out there who have to go through all this hassle. But in the end its all worth it because it strengthens you as human being and makes your relationship a bit more special because you have to bear the separation makes both sides value each other more or well it should in theory ;-)

Alhamdulillah my wife got her visa yesterday this is our timeline:

Applied 15 Aug 2012
Applied as employed since 2010 salary £18k, Self employed £10k, rental income £9.5k
RFC 15 November 2012
Visa refused due to not meeting financial requirement not providing 12 months bank statements showing rent even though i had written a letter and witness statement with tax returns showing i receive rent cash in hand.
Appealed decision 5th Decision 2012
Tole to wait for ECM review Deadline given by FTT: 5th June 2013
No reply from ECM review
Given Court Date 14 Jan 2014 @ birmingham
Re applied while appeal for 1st application was pending on 25th June 2013showing 6 months of rent and employment @18k and no self employmen this time
Decision put on Hold 26th September again due to financial requirement not being met eco confused weather why i am employed by my employer since 2010 but applied as self employed in inital application in 2012 and also not providing 12 months bank statements for rent again
Deadline for new docs or explanation to my circumstances by Oct 15 2013
Wrote letter explaining that when I applied first time i was both employed and self employed and hence applied in both categories but no longer in self employment only in employment which has been running since 2010 also explained that even though i only gave 6 months bank statements rather than 12 I am allowed to do this according to thier financial appendix gave them refrences and therfore to count my income from rent to make up shortfall of £600
Email from BHC on 22/10/2013 @ 4:20 am advising me my application had been concluded and should hear from visa centre soon
RFC For 2nd application 22nd October 2013
Rang First Tier Tribunal and withdrew appeal from first application on 23/10/2013
Wife collected passport with Visa Stamped :-)
Coming to the uk on Sunday :-)

Big relief feel drained!
Only thing I can say I have learnt apart from all the emotional side is that when we are applying especially in PAK that if you salary is not @ around £20,000 through a proper employer with 6 months wage slips don't apply I know they have all these categories that you can combine to make up the financial amount but the bhc staff dont understand it so they are reject it so just think it through!
