Dear all,

I would be grateful to all of you who will try to help me here.

Our Background:

Father is a British Citizen, Spouse has ILR and has applied for her Naturalization and is currently under process.

Spouse will be travelling India to deliver a baby.

Questions:

(1) What will be the nationality of the new born baby? Indian / British
(2) Based on what will the baby's Citizenship be decided?
(3) What documents are we expected to submit for Indian and British Embassies?

Please advise. Thanks in advance.

If child's father or mother was naturalised prior to child's birth, then child is automatically a British citizen by descent (2(1)(a)).

If mother hasn't been granted British citizenship when child is born, then baby may also be Indian?
