raume wrote:Hi everyone,

Need a little advice here.
Me&My unmarried partner applied in July, received COA in Aug and now waiting for the RC. I am the EEA National, and my partner is the non-EEA. We applied on the basis that I am employed.

As you know there was a section on the application form where the EEA national's monthly income is asked. I've put in my monthly salary, however this month I received a one-off bonus, and bonuses are also run through the PAYE just as they were a part of the salary, so if/when the HO checks in with HMRC, they will see the extra payment made this month, and I'm worried that this might seem as a discrepancy. So the question is, do you think this is something I need to inform the HO about, by sending the relevant payslip and a letter from employer explaining the payment? Do you think this counts as 'change of circumstances'? Any advice/opinion would be much appreciated.

Btw congratulations to everyone who have recently received their RCs!
Hi raume

I am also an unmarried partner and my EEA partner also receives bonus (at the begining of the year).

Short answer is: NO!!! don't over complicate yourself!

Bonus are quite a common thing for regular, full-time employees, and provided you filled in the form honestly and correctly, there should not be a problem (I don't remember there being a question about bonuses in the form, so I don't think they want to know that). Also, I would be very surprised if the HO checked every single payment your company makes to you, for the following months after you apply!!! Why would they go through that hassle???

Provided you have submitted the original payslips in your application, which normally match what you declared in the form, that should be enough evidence of your regular circumstances.

And no, a bonus is not a change in circumstances!!!
Hi Kamoe,
You're probably right. It's helpful to hear the opinions of people on this forum, who are going through the same process and with similar circumstances so thanks a lot for the input.

Hi Leandro!

I can see you have not received the COA letter yet. Is your wife currently working? When is her FP going to expire?

She isn't working at the moment.. We're waiting for the CoA or the RC.. I've sent some emails and tried to call HO with no success to get her CoA at least. Her FP has expired in August. I haven't received any emails for my QP as well. It's funny as each HO case worker has different procedures.

Leandro, I would follow the advise from several other members of this board:

You can send them a mail and ask for a COA, to: nweurocoarequests@homeoffice.gsi.gov.uk
In the email include your wife's case id, your wife's passport no, her date of birth and name. Do let them know that as a married applicant they have to issue a CoA with right to work, and that they have not done so. That should work!

Hard to answer precisely, but if you go back a few pages, you will see that the latest updates to the September timeline shows that CoA with right to work for FM takes about a month, give or take two or three days. I think you need to be prepared to wait a few more days than your expected date, just to be on the safe side.

Thank you for you pre-action protocol communication concerning the refusal (dated 29 september 2015) of your application for Residence card. You express surpise at the refusal and do not understand it, considering the evidence and information you provided.

Perhaps the explanation could have been clearer. The decision maker considers applications in stages, and each stage confirms that certain obligations have been met by the applicant, leading one stage into the next. The final stage is to recognise that all conditions are met. Unfortunately your application, detailed though it was, fell at the first stage that is, whether you have provided the requisite identity document(s). Although the refusal letter sets out the provision that

17.—(1) The Secretary of State must issue a residence card to a person who is not an EEA national and is the family member of a qualified person or of an EEA national with a permanent right of residence under regulation 15 on application and production of—
(a)a valid passport; and
(b)proof that the applicant is such a family member.

it does not clearly say, for which we apologise, that the passport ( that you explained was already in our possession), expired on 4 November 2013 and its thus not valid. Consequently your application was refused. As you have noticed, the letters refers to 17(1)(b) whereas it would better have referred to 17(1).

We apologise for that error also. Although you also provided an ARC card, this was not acceptable because your asylum application was refused and appeal rights have been exhausted. In the light of the foregoing, it is improbable that the court would find our action unlawful in conjunction with this explanation.

You might consider obtaining an up to date valid passport and applying again. If you cannot do so for reasons beyond your control, you might wish to fully explain the circumstances and provide an alternative form of identity with your application, for consideration

Hi Nora_804,
Processes and procedures for EEA documentation applications V3.0 Published for Home Office staff on 08 October 2015

It give clear instructions about

Hope it help.

Hi Kamoe,

My first biometric letter was missing (i found out in my second biometric letter) and they mailed another biometric letter to me. Unfortunately, the letter was delivered to the wrong place and i got it on the last day of biometric enrolment. It was a disaster! In the letter written i only have 10 days to enrol my biometrics if i don't do it within the time given and without any explanation; they will straight away reject my application. I rushed to the post office immediately the staff told me i must make an appointment. I was panic and seek help from the post office staff. End up, they tried to help me. I was so relieved. I can't imagine what if i don't receive the biometric letter and they just reject my application. I thought they suppose to check with us why we don't enrol our biometric before reject the application. Letter went missing or delivered to the wrong place is beyond our control!

Biometric Letter Date: 30th September 2015
Received and Enrol Biometrics: 12 October 2015
