Sorry

I was not avoiding the HSMP route. I was told that applying for HSMP was a dead end. As I am would be required to show maintenance, which I don't have 3 months bank statements as I havent been working for years. Though I have an msc in the uk

Hence pls Note my questions are genuine.


I was told to follow this path

As neither you or your ex are permanently resident and both subject to potential removal then there is no obvious avenue to pursue. You can't say family and private life as the entire family can all return to your home country and carry it on there.
What route is your ex trying?

I spoke at length today with a barrister and he said to both try both parent routes independently with exceptional circumstances (as there is clearly a clause there£

I spoke to my ex and she agreed.

Last resort is HR claim.

Our daughter is 10 next year.

I believe there is hope

Good luck with that advice. Your claim will fail out of hand given what you have stated here. Your ex has a marginally better chance, still well below 50% though.
