He has not allowed your appeal. He gave permission to appeal. An appeal will only be allowed once the decision of the FTT has been set aside, then the Upper Tribunal will decide to remake decision and allow appeal.

Furthermore, he cannot say there is error of law, he possibly said there is an arguable error of law. It is at a hearing that the question of whether there was an error of law will be dealt with.
