Hey guys. I've been watching this thread for a while. I have one question. If a EEA family permit is refused is there a refusal answer sent via email or is it a letter made available when collecting the passport?

I'm irish, wife and her son (4 years old) are Mexican.

Now I need to pay for courier to have passports sent.

My timeline

Applied:12th January
Biometrics: 30th January
Liverpool receipt acknowledgement: 3rd February
Passports ready for collection: 21 February.

That's great news, it's the least you deserved after all 8 Months of what I'm sure was nail biting, hair pulling waiting.

I'm sure you're getting ready to go the UK, although it's rather miserable right now with all the rain, but it will get better from March.

Please could you be so kind enough to tell us what proof you submitted for your own personal situation for example your Income, Expenditure and how your money from your Sponsor is spent?

Dear All,

I will be very grateful if anybody could assist;

I would like to apply EEA Family permit as an extended family member for my brother. I am non-eu national and my wife is dual uk-eu national ( I have settled status). I want my brother to make an application where he is dependent on my wife (us). but Version 7.0 of Free Movement Rights: extended family members of EEA nationals definition part ends with;

From 1 February 2017 the rights of extended family members only applies to
relatives of the EEA national and not to relatives of the EEA national’s spouse or civil
partner. This means that an extended family member can no longer rely on their
relationship to the EEA national’s spouse or civil partner in order to meet the
requirements of regulation 8. Instead, they must show that they are related to the
EEA national.


This worries me as my brother as per this definition does not fall under the category of extended family member. That being said, I have seen some cases in this form where people are keep applying as an extended family members and relying on their siblings eu spouses.

Is there I am missing something? The only way i could reason it was going by The Immigration (European Economic Area) Regulations 2016 section-7 clause-1 (c) dependent direct relatives in A’s ascending line, or in that of A’s spouse or civil partner. So he could apply as a dependent of mine...

However, in the very next section which is 8, it contradicts with their guidelines where it says in clause-7 In paragraphs (2) and (3), “relative of an EEA national” includes a relative of the spouse or civil partner of an EEA national where on the basis of being an extended family member a person—

(a)has prior to the 1st February 2017 been issued with—
(i)an EEA family permit;
(ii)a registration certificate; or
(iii)a residence card; and

In plain words what i am asking, should my brother apply eea fp as an extended family member and depended upon the eea national or should I look for other visa types? Any assistance will be appreciated.

I did my biometric on the 14th of February and I've only received acknowledgment from Liverpool.
How long do I have to wait now?

Hi all,

Just an update I contacted UKVI via telephone today and they confirmed that a decision has been made, this being said my nerves are finished!

I have yet to receive a notification via text or email stating my documents are ready etc so my question is from experience how long does it normally take to get your documents back?

I will be glad to post my outcome as soon as I have my passport in hand!

I have just received 2 similar mails today. One saying that my application isn’t straightforward & the other requesting for my wifes original eea passport to be sent to them.

I noticed you heard back from them in two days so please can you share if you got it. I’m so nervous right now. I’m gonna ask her to send her passport tomorrow.

An alternative to applying as an Extended family member is to apply under the 'EU Settlement Scheme Family Permit'.

Sorry. I have not fully explained. I have already applied for my mother in law and she was granted the permit in December. We applied for both of them at the same time however mother in law was granted and sister in law was rejected. We had attached the exact same evidence. The refusal reason did not mention anything about only sending 6 months money slips so we assumed they were okay with it. They stated they wanted more evidence of income expenditure and financial situation. And that the money we send is used to meet her essential life needs.
So we sent the exact same evidence but this time included bills and explained their monthly budget/ expenses in detail.
Then this rejection they said 7 months is not enough and asked for collection receipts.

We send money in the name of my mother in law and they have accepted that saying “It is noted that the corresponding money collection receipts or a bank statement in your Mother’s name have not been submitted to verify any of these funds were received by your Mother”

I have emailed the EU settlement resolution team asking if dependent sister in law of 13 years old can apply for the EU Settlement Scheme family permit.

Yes your wife can sponsor both your parents under EU settlement scheme family permit as long as you can prove your relationship and she has pre settled or settled status. It’s very easy and although dependency is assumed, it’s also good if you can send evidence that they depend on you.

I think your problem will be when your parents are granted the permit but your brother might be refused even though he is 5 years old.
They accepted my mother in law but rejected my sister in law and now we have even bigger issue because she can’t live by herself and my mother in laws permit will expire June. She still has not come to the UK.

So think wisely before applying. There is no way to link all their applications, you have to do a seperate one for each. Since the EU Settlement Scheme fp is easier there is a big chance they will accept both your parents but you have to apply for EEA fp for your brother since he is extended family and there is a chance he might be rejected then he will be by himself.

I applied for my husbands mother (my mother in law). Because he didn’t have a birth certificate “registered at the time of his birth”, him and his mother did a gov.uk approved DNA test. So we didn’t use a birth certificate in our case.

I think you only need to include and translate your birth certificate as this contains your mums name too but I have seen several cases where family permit was refused because the “Date” on the birth certificate was several years after the actual birth so just be sure to check and any translated papers should have original dates of registration.

All documents not in English have to be translated.

In our case, we included the following:
1. Application form and booking appointment letter
2. Passport photocopies of EEA national, husband and mother in law
3. Cover letter
4. EEA national employment letter
5. Settled status letter
6. 6 months payslips and 3 P60’s (both EEA National and husband)
7. Marriage certificate of EEA National and husband
8. DNA test of husband and mother in law
9. 6 months UK bank statement
10. 6 months money transfer slips
11. Flight tickets, photos, TB test certificate
12. My own children’s passport copies and birth certificates

I've Appealed the last refusal and also filed a new Application at the same time.

I even mentioned on there that I am appealing and attached the Confirmation notice from the Court.

Hello everyone,

The situation around the world is really sad due to the outbreak of Corona virus.
I have my EEA family permit with me but still cannot travel to UK since all the flights are suspended for a month.

Hopefully the situation will be better in the coming months. I just wanted to know if anyone can help me out with my query.

Is it necessary to travel to UK within first 3 months of the visa start date. Is it a problem if someone die to unavoidable circumstances travels after 3 months of the visa start date??

And currently how long does it take to get pre settled status after moving to UK ??

There is no law that forces you to come within 3 months. You can come to the UK in last month of your FP. There is no definite time period for settlement scheme to process as it varies case to case. According to recent information keep in mind at least couple of months. Stay safe and do not worry about coming asap. Later is better than sooner as UK is going to be next hotsopt of Covid-19. Almighty bless everyone in this situation

Hopefully things will be fine soon.
Anyways I cannot travel asap as till 15th Apr 2020 the incoming as well as outgoing flights are suspended. So let's see later in May maybe.

Just to update, we decided to submit another application for one last time before we appeal.

Timeline:
Online application: 27/02/2020
Biometrics: 03/03/2020
Received by UKVI: 04/03/2020
Not straightforward email: 23/03/2020

On the 18th, we have UKVI a call and they said a decision has been made. Then today when we received this email, we gave them another call. The lady said the decision had been made and couldn’t explain why we received the not straightforward email. Very confusing.
Just waiting for get an email from TLScontact now.

Please will this affect my application?
I'm his son. I was refused the first time in February, I was about to go for the appointment on 27th of March but TLScontact(VAC) shut down all operations.
Please people will this affect me?

Hi Shercorp,
I am sorry for your loss. I am not an expert but I think you shouldn’t let that discourage you. You mentioned that you are about to go for appointment at the VAC so that means you already applied which is good. Just be patient bro. I believe they will open when all this is over and your application will be processed. The only problem I see is not being able to provide your sponsors valid id when ask as they seem to always do for EU family permit applications but if you can provide it, great.

Hello guys,

Just to update, we decided to submit another application for one last time before we appeal.

Timeline:
Online application: 27/02/2020
Biometrics: 03/03/2020
Received by UKVI: 04/03/2020
Not straightforward email: 23/03/2020

On the 18th, we have UKVI a call and they said a decision has been made. Then today when we received this email, we gave them another call. The lady said the decision had been made and couldn’t explain why we received the not straightforward email. Very confusing.
Just waiting for get an email from TLScontact now.

I applied for my mum biometric done on 12/03/2020 and I received not straightforward email on 24/03/2020 contacting them yesterday they said its still waiting for decision and they escalate the case and they said I should hear from them within 15 working days

Hey Tiktok,

No, nothing yet. They made a decision on our application but they probably haven’t been able to send the documents. Anyway the visa application centre is now closed so it looks like we won’t hear back from them until things return to normal. I’ll write on here any news we get, although we aren’t too hopeful because of all the refusals lately.

Don’t worry, they’ll probably reach a decision on your mum soon, they must have a shortage of staff due to the pandemic.

Keep us updated, I hope you get a positive result.
