Please help me, when to apply for ILR.

Post by orangepillow » Sat Sep 28, 2013 4:20 pm

Hi
I am from non-EU
came uk with student visa on October2008 till April2009
I got married April2009 with EU member, and got Residence Card on September2009 to September 2014
If I can ask who can help me, when exactly date I can apply for ILR?
How long before I can put my Applications?
And do I need to Pass life in the UK for ILR? or does it need only for citizenship?
Many thanks indeed for any respond.
Regards
Laura

This should be in the EEA forum, you don't get ILR under EU law you attain permanent residency (PR) after 5 years (if your spouse has exercised treaty rights for those 5 years). PR is akin to ILR, they both imply settlement. Yes your will need to meet KoLL for nationalisation, when you apply that will at least include the LIUK test and a B1 language requirement providing you are not exempt.

Exercising treaty right:

employed or self-employed; or
studying; or
economically self- sufficient (meaning that you have sufficient funds to support you without requiring public funds); or
a jobseeker; or
retired; or
someone who has had to cease working in the UK owing to permanent incapacity.

You don't need any test for PR application yet

5 years after marriage

fees £55

You asked this question before about test: NO TEST for PR application. Test is only when you applying under UK LAW ( when you apply for British Citizenship later after PR )

You don't need to include his work history anymore as it will make the case complicated : remember you are family member of a Permanent resident holder in the UK

because your PR application will be very straightforward just send what is required

- Your and his Passport

- His PR certificate

- Your 5 years proof of address

- marriage certificate

- and a cover letter explaining everything
UK Student Visa : 04/2004 - 09/2009
EEA Residence Card : 07/2010 - 7/2015
EU Settled Status: Confirmed on 16th July 2019
Naturalisation : Confirmed on 02nd Oct 2020
Passport Approval : 21st Feb 2021

if EU national already have PR then you don't need to prove his 5 years exercising treaty right anymore just send PR certificate with other required documents so i am sure your application will be straight forward and there is nothing to worry

It doesn't matter what you and your husband doing now as he already have PR

PR for EEA?

Post by rogerex » Tue Oct 15, 2013 5:13 pm

Hi, sorry to interrupt in your thread and let me know if it bothers you and I'll open a new one; but I post it here as my situation is almost identical but I have the following question:

I'm a non EEA married to a EEA; we both work full time. we have been married for 5 years and my EEA2 cars will expire in march 2014. I want to apply for the PR; from what i read here I have this questions:

1) My wife is european but has never applied for PR as she doesn't need it; would it make my application more straight forward if she had this?

2) As we have been married for 5 years I assume I can apply anytime from now?

Many thanks for your help.

Thank you; now my question is: Is it worth for me ask her to get a PR residency; so when I apply to mine is easier or shall I just do it now?

Also when specifically can I apply for the PR? my definite leave to remain finishes in March 2014.

Many thanks

Gary

You already married for 5 years so you both can apply

You can send EEA3 / EEA4 together.

Dear Guru's
Can you please help about my questions?
So, as I wrote previously
My eu husband got approval and he will be BC hopefully before our 5th year marriage,
Now;
When I got married April 09 till December 09 no any employment or council tax or any bill from me,
All bills was paid by landlord. I became self employe 09 December, do I have any chance to apply Naturalisation?
Since registered hRM till now working.
Do I need 3 years or 5 years residence? How to proof?
Thanks
