Citizen by Descent or Other than by Descent

Post by federyko1979 » Sat May 23, 2015 8:32 am

My situation looks like that:

Me and my wife came from Poland to UK in 09.2007
We both are working continuously from 11.2007.
1st son (Olaf) born in 04.2011 in UK (registered in 05.2015)
2nd son (Adam) born in 11.2014 in UK (did not register but applied straight for British passport - got it in 02.2015)

Neither me nor my wife are British citizens. Our parents are not British citizens and no one from them was born in UK.

Logically thinking both my sons should be citizens "other than by descent" (cause there is no one they could get the citizenship from by descent) but just wanted to be sure. Maybe now it's not so important but in 20 years time you never know.

Questions:
1. Are both my sons citizens "other than by descent"?
2. My 2nd son (Adam) did not receive any registration certificate. Does that mean that he has been registered or not? If yes - can I get his certificate number from somewhere?
3. If me and my wife will pass naturalisation will we be citizens "other than by descent"? will that change our sons citizenship status (I mean will they then be citizens "by descent"?)

1. Your children are British citizens "otherwise than by descent" because they were born in the UK to parents who are considered settled in the UK by virtue of Permanent Residency under the EEA Regulations.

3. If your wife and you were to naturalise, you too will become "citizens otherwise than by descent". That does not affect your children's status.

What about registration of my 2nd son? Is he registered? If yes where can I get his registration number?

Children, who are automatically British, cannot be registered.

You dont need to register as vinny mentioned. I did a check on this link and you can simply apply for his British Passport.
Being British is a state of mind.
