Spouse visa of my wife

Post by jimmy_110 » Thu Sep 24, 2015 7:26 pm

Hi,

First thing first, a brief history of myself. I'm a naturalised british citizen and holding pakistani nationality as well. originally from Pakistan and currently living in London, work in London as a Software Engineer.

I'm quite confused about how to make application for my wife's spouse visa.

Reason is, I got married to my wife in PK in 2010 and I came back to UK, used to visit every now and then to PK. Then I got married in UK again with british woman in May 2012, then I switched as her spouse and I got naturalised citizenship, then my divorce took place in Oct 2014 from British wife due to domestic/social issues.

Now I want to call my wife from PK to UK, quite confused, would I run in any problem if I apply without stating all this backend story of mine. Or how could I go about to get my wife over in a legal way.

Any reply would be much appreciated.

Many thanks
J

This may be more complex than you think.
Where were you domiciled when you contracted to marry wife #2? In UK?

Was wife #1 aware of wife #2 (& vice versa)?
Was wife #2 used as the basis for your settlement in UK & naturalisation?

Was wife #1 declared to UK authorities (eg registrar) when you arranged the wedding & wife #2?
if you were not free to marry wife #2 then your second marriage would have been of dubious legal standing & family law offences may have been committed.

Any information related to your marital status & spouse, as provided by you in connection with visa, settlement & naturalisation applications, may be called into question, in term of full & frank disclosure of material facts.

Some or all of the above considerations may impact any current spouse visa application.
There may be consequences for your previous settlement & naturalisation depending on what was disclosed to the authorities at the time.

Suggest you consult a lawyer experienced & competent in this area to dig into & progress this matter.

So you acquired your 2nd marriage and spouse visa (and ILR and naturalisation) fraudulently?? And now you want to further abuse the UK system and break UK laws? Am I hearing this right?

There are potentially two issues here:
Criminal charges due to bigamy
Revocation of British Citizenship and ILR due to deception
(Casa, not CR001)

Criminal charges and revocation of BC and ILR.

Too many checks now mate, you're on borrowed time.

Realistically, unless you are prepared to face serious consequences, you're never going to be able to apply for your wife to settle in the UK. An application will immediately uncover the deception that enabled you to obtain ILR and British Citizenship.
