Surrinder Singh route for Dependant Mother and 17 yro sister

Post by Kafiz » Mon Feb 08, 2016 1:18 pm

Hi,

I have read a lot about SS route on this great forum and the internet.

I am considering that for my Mother and 17 yro sister who are dependant on me financially.
My sister is an extended family member and the possibility of her fitting the SS route will depend on the out come of Kamila Santos vs Secretary of state (because the latest I know regarding the case, thanks to posts by Board members, is that the HO has appealed against the upper tribunal's decision of allowing SS route to be considered for extended family members too).

But is that the only category or can she possibly be considered e.g. as the dependant of a dependant(my Mother)?

Also, is there a place to track when the case above gets finalized?

Your Help would be much appreciated.

Many Thanks,
Kafiz

No, she cannot. She has to be dependent on you.

Your mother gets automatic rights as your dependent, your sister does not.

When any decision from the court is handed down this forum (& possibly https://www.freemovement.org.uk) will be great places to check.

This guidance will help you get up to speed on the ins & outs of extended family members, including sisters:

Many Thanks CR001.

Hopefully the Kamila Santos case would reach a favourable conclusion soon.

Any advice as to where the latest on the case can be tracked?

You are of course presuming that the UK does not vote to leave the EU in June this year.

If it were to, no EU=no EU law=No Surinder Singh.

Also, even if wee were to stay as a part of the EU, part of the negotiations is to tighten the rules on Surinder Singh. Things may change well before the judgement.

Yup,

Both these outcomes are on my radar.

Though I have heard that the implementation of the out of EU decision, if it goes down that route, may take some time. My current Job would finish by end of June so hopefully by that time things would be clearer.

Anyways, Let's see what happens.

Thanks
