Funding criteria for Spouse Visa

Hello,

I’m an Indian national currently on Tier-2 general visa (from May 2015) until May 2018. Also, I am getting married to my gf who is a British citizen, this year. My gf is a full-time student and has no income and I earn more than £25k per annum – will this fulfil the funding criteria for Spouse Visa? Please advice.

Your income alone will qualify.

Spouse Visa application from Inside the UK.

Hello All,

I am an Indian national and currently in the UK on Tier 2 general visa (until 25th May 2018). I intend to marry my British fiancee by the end of this year and apply for spouse visa (or family of a settled person visa) Could anyone please advise or respond to my queries below?:

1. Documents required for spouse visa application -
(a) my passport,
(b) biometric residence permit,
(c) proof of income (payslips),
(d) marriage certificate
(e) English language knowledge (my MSc certificate from UK university)
Am I missing out on any other document(s)?

2. My current Tier 2 is valid until the 25th May 2018 so will I have to apply for switching to Spouse Visa at least 6months before the Tier 2 valid-until date?

I'm looking forward to the replies. Your support will be greatly appreciated.

1. Read the FLR(M) form, it tells you what you must submit (roughly page 62/63)

2. You can apply at anytime before your current visa expires and can apply by post or in person. Remember you must inform your employer when your visa has changed.

Accommodation criteria for spouse visa.

Hello All,

FLR(M) Version 04/2017 Page 63 of 79 states:
'If you and your partner lived with relatives or friends for some or all of the period you are relying
on, please provide a letter from the relative(s) and/or friend(s) confirming this.'

I will live at my fiancee's parental house along with her and her parents in Edinburgh, UK, after our marriage. So, I will provide a letter from her parents for fulfilling the 'accommodation' criteria for Spouse Visa. My query is, will the said letter from her parents have to be attested/stamped by a legal authority (like public notary etc.)?

Please advise. Your support will be greatly appreciated.

Minimum time duration requirement for relationship forFLR(M)

My query is, is there a minimum time duration requirement stated anywhere in the FLR(M) guidelines that need to be shown for 1. from start of relationship until marriage day & 2. from marriage day until the date of spouse visa application? Please advise.

no this does not be notorised if the letter is from a UK source you are providing.

You can apply at any time once you are married but it must be before your current visa expires. Don't forget that you will have to inform your employer once you get your spouse visa and provide them with your proof of right to work.

There is no template letter for accommodation. Simply write the facts and provide evidence for parents such as tenancy agreement or title deeds etc.

Spouse's parents got their house on mortgage so will need to show their mortgage document along with the letter from them stating I live at their house, is it?

Also, along with 6months' payslips, do I need to provide 6months of bank statement as well?

Yes to both your questions. You also need to provide an employer letter detailing ypur particulars.

So I am thinking of providing the following documents in original for FLR(M):

1. 6months payslips & bank statement for my salary account (proof of income)

2. P60 & letter from employer (proof of income)

3. letter from spouse's parents stating that i stay at their house (proof of address/acco)

4. statement of both of our joint savings Bank account (proof of address/acco)

5. statement of both of our scottish building society account (proof of address/acco)

6. hmrc letter for both of us (proof of address/acco)

7. GP letter for both of us (proof of address/acco)

8. marriage certificate (proof of marriage)

9. both of our passport & my current Tier 2 BRP

10. Our online chats, photos, proof of trips together, engagement ring receipt etc. (for relationship proof prior & post marriage)

Also, will include a print of the scan of the title deed of spouse's parents' house.

CR001, anything else that would recommend that I should include to the above list? (Am I missing out on anything?)

Not needed but if you have been living together, you need to submit more evidence of cohabitation.

Hi CR001,

Regarding your advise of providing more proof of cohabitation, please allow me to quickly explain our situation.

My girlfriend and I, both live in Edinburgh since we met & went into relationship in Nov 2016. From then to present, ON THE PAPERS, she lives at her parental house (in Edinburgh) and I live at rented house (in Edinburgh as well). We plan to get married in Nov/Dec 2017 and I plan to apply for FLR(M) in May 2018.

After marriage, I would stay at her parents' house. So, do you think (as per the UKVI rules) I'll still need to provide 6 no. of joint address proofs? (I am also providing a letter from her parents stating that we both live at their house)

I am a bit confused. Do I need to show 2years of cohabitation before marriage or something like that?

Could you please advise? CR001, your support is much appreciated.
