I have just gone through the Tier 1 guidance notes in which they mention that to fulfill the maintenance requirement "Personal bank or building society statements covering the 3 month period immediately preceding the application" is required and "that there are sufficient funds present in the account i.e. the balance must always be at least £800"
Maintaning a minimum level of funds throughout the last three month period just came out from the dark. I need to apply to switch into Tier 1 alongwith my wife and twin daughters before April as my birthday is looming. Although, I have maintained 2500 + throughout dec and jan, but in feb my balance went down to 800 + for about two weeks.
Now if we take the interpretation that throughout 3 month period if your balance (balance forward on each single day) goes below minimum maintenance level your application will be refused (will they refuse the main applicant and dependants together OR just the dependants considering dependants applying on separate forms and balanace was always 800 + though not enough for dependants but enough for the main applicant ??).
Slightly relaxed interpretation would be balance forward at the end of each month throughout the last three months is above the minimum level. How likely do you think this could be the case?
In the worst case, if I apply alone (because of maintenance issue) I then have to pay an extra 1200 pounds for the dependant applications. Can't they just see if someone has lived in this country so long without claiming benefits, wouldn't claim in future as well or they have introduced yet another pointless hurdle to deter people becoming Highly skilled migrants.
I would appreciate any comments or thoughts you guys have.
