HSMP dependant Visa Issue -urgent Please

Post by meghs18in » Mon Aug 11, 2008 7:04 pm

Hello All,

I have a friend who has got married to a HSMP visa holder and she is on dependant visa on his. Both of their visa's expiring this 23rd August. She was not made aware until yesterday that he is not interested to extend her visa any more and that they have personal issues in their married life. However now the big problem is , there are just few days left on her visa and additionally her parents back home think if there was a lawfull way in which she could claim her dependancy on that person and stay in the UK (in the hope that if they are togather for a little longer, it might help to bind their marriage which is on the rocks). Is there any solicitor or agency she could approach who could deal with these sort of issues? Can she claim / appeal / register a case claiming her husband abondoned her last minute when he got his wife as a dependant? Can she still be eligible for other category visas?

Thanks for whoever replies.

Meg

Since this isn't a query concerning HSMP / Tier 1 scheme per se but to do more with future immigration status of a dependent in marital distress, you will have a better chance of getting responses / suggestions if you post the query in the appropriate forum i.e. - General UK Immigration forum

Regarding the question of changing over to another immigration category, AFAIK the dependent needs to return to home country and apply for EC on basis of (any) immigration category he/she might be eligible for (and applies under), 'coz dependents are not allowed to switch in-country.
