Confusion-when exactly the extension period starting from?

Post by rice_porridge » Thu Nov 19, 2009 4:36 pm

Dear all:
not sure if you are interested in this topic.

for example, if a hsmp holder's leave expires on 1st December 2009. and he is going to make a premium T1G Extension application in croydon on 15th November 2009. and say if his visa is granted.

My question is: when the extension date will be given from?
is it from his previous visa expiray date (1st Dec 2009) + 3yrs,
or is it from his application date (15th Nov 2009) + 3yrs.

Thanks

Generally(and mostly) from (1st Dec 2009) + 3yrs. Sometimes (15th Nov 2009) + 3yrs.

Depend on Case worker. But usually they issue new Visa from the date your current visa expires.

The risk is:
the casework will extend my visa from the date I apply not the date my preivous expiry date of leave. in this case, I will be short of 5 years and cannot apply for ILR.
Am I right?

You can apply for ILR within 28days in advance and if you are even short by these days will be Ok and covered.. so you shoud be fine if ur current visa expires on 1st Dec 09
