Indefinite leave to remain doubts

Post by trachu » Tue Mar 02, 2010 6:31 pm

Hi

I have received approval letter from home under HSMP on 5th April 2006. Home office said they have received my application for HSMP on 3rd April 2006 . Now I wanted to apply for Indefinite leave to remain under judicial review. When asked home office, two officers gave me different answer . One said , Yes would qualify.. the other said No. I would be grateful if anyone can give any further advise

Many thanks

trach

Do you still have your acknowledgment letter (of receipt of application)? Or receipt from post office or courier? That would have the date. You would have had to send the application before 3rd April.

Alternatively, you can ask for your SAR file (there is a sticky thread on how to obtain this) pertaining to your HSMP application and extensions. Ask for a photocopy of your HSMP application, this will have the date stamped on the top page. If it's before 3rd of April 2006 then you qualify for the JR.
