spouse applying for FLR---hasnt passed KOL---please help

Post by manzar » Wed Dec 15, 2010 12:21 pm

hello all,

My spouse came to the uk on 31 oct 2008 on a spouse visa. Her current leave to remain visa expires 25 dec 2010.

We are looking to apply for extension of leave to remain via form flr(m).

She hasnt passed a1 english, she has just paased pre english and in janauary is enrolled to start a1 course.

My questions are?

1. the form flr(m) says that a spouse needs to have at least A1 english to apply for extention. Is there no way of getting extension even for a few months so she can pass the course.

2. Am i using the right form to apply for extension?

3. Is there any right of appeal when you apply via flr (m) form.

4. how quickly do they reply and whats the worse that can happen and whats likely to happen.

We didnt know rules will change for those present in uk. Backroung info: We have a 7 months daughter and my wife had a very hard pregnancy and complications after the caeserian operation. i work full time.

Please can you guide us with problem. Please advice answer to above and how do we get extension of leave to remain.

Thank you all in advance for your help.

Kindest Regards

1. No. (284(ix))
2. FLR(M).
3. If the decision on extension application is reached after expiry of current leave, right of appeal is granted.
4. Given the circumstances, she will be denied further leave to remain in the UK.
