Visa Issues of Non-EU National Co-owning UK Business

Post by mhwadester15 » Fri Oct 11, 2019 5:20 pm

Hello,

So I am a 28 year Australian citizen currently living and working in the UK on a Tier 5: Youth Mobility visa, which expires on 10/02/2020. As I don’t plan to go back to Australia after it expires I was thinking of moving to another European country (ie. Ireland or Norway) on another working holiday visa.

Currently I work for a UK fish vaccination company that works for fish farms across Europe and UK. Me and my co-worker have been discussing the idea of starting our own vaccination business and working directly for a farm in Iceland as we have built up a good relationship with them and they have offered us a contract. However, they would require the contract to be a year minimum, which wouldn’t be possible given my current visa expiration date. In saying this, my questions are as follows:

1. Are there any other options to legally work in Iceland as co-owner of a UK company after my visa expiry?, as I have read you cannot switch to other work or business based UK visas from Tier 5, within the UK at least.
2. If not, would it be possible to continue the business whilst in another country on a working holiday? Or potentially as an employer of my co-workers business.

Another question unrelated to the previous two questions. I have read that border control/immigration ask a lot more questions to people entering the UK directly after T5 visa expiry. If I was living in another country on a working holiday and wanted to travel to UK to visit family/friends but booked return flights, would that cause any issue at immigration control?

Any help or advice you could give on my questions would be appreciated as this a weirdly specific question/s. I know I probably have posted this in the wrong sub-forum, but I was unsure.

Thanks.

They may ask questions to ensure the person is not leaving the UK just to "reset" counters then coming back immediately as visitor again and again. But unless people do that systematically and over a long period of time, they are not refused entry.

Also, with a UK work visa, you can't work in Iceland.

There is no such EEA work visa. No country can issue a work visa valid EEA-wide. As non-EEA, the best you can do is to have a work visa in a single EEA country of your choice. If your project is now mainly in Iceland, you may need to apply for a visa there. But a UK work visa won't help you if the business is mainly done in Iceland.
