FLR(M) Extension plus confusing sections

Post by JAGOO » Fri May 23, 2014 9:06 pm

Hi,

I hope somebody can help me.

1. Husband got ILR 2 years ago and now applied for citizenship recently (timeline under a different topic)
2. I came back (new entry clearance for 33 months) as a dependent of a settled person last year.
3. I was just reading the FLR(M) form to read upon applying for an extension (I know its not due yet) and got confused on the following points.

I. Section 2 Question 2.2 (Do I need to tick yes or no where it says "Is this the first time you have applied for a visa or extension of stay in one of the above categories). My understanding is to apply NO and then answer the 2.3 with the option which says "First period of leave to remain following an initial period of entry clearance as a partner of a settled person.

II. After completing Section 7A (Financial requirements) it says proceed to Section 7C but what about Section 7B (Maintenance section) where it asks for different details plus the Question 7.6 for public funds as my husband is receiving public funds (Working tax credit and soon to receive child benefits (Child is British born last month).

III. Section 12 (Documents) 12B which I understand that I need to submit my marriage certificate which is fine.
IV. Do I need to complete 12C as well where it says it you have completed 2 years in that category but I am confused as I came under the 5 years route and not 2 years route so I am confused on it. Gov website states use this form for both routes (2 or 5 years).

Sorry for so many questions but they are confusing me so much. I would really appreciate your advice on this.

I – Your understanding is correct.
II – 7B is N/A, 7.6 yes state tax credits (which should be in joint names) and Child benefit, under your spouse/partner.
III – Yes.
IV – Yes, I think it’s just badly worded.

Hi Amber,

Thank you very much for your reply and valuable advice. However, as mentioned in my point (II) when completing the Section 7A it says proceed to Section 7C which means that I should skip Section 7B (Maintenance) correct? Upon reading the instructions for Section 7B (Maintenance). It says you only need to complete this section only if you

(1) qualify for an exemption or
(2) you were granted leave to enter or remain as a partner under Chapter 8 of the rules following an application before 9 July 2012

Now again both do not apply to me as came back with a new entry clearance under the 5 years route so that section is not for me to fill in. Another point Question 7.6 for Public Funds is part of the Section 7B (Maintenance) so does that mean I am not required to fill it in.

I hope you understand what I am trying to say as you mentioned in your reply that Yes to 7.6 and then answer that it is my husband who is claiming and not me. I am confused as this question is part of the Section 7B (Maintenance).

Looking for your valuable opinion on this issue.
