I have been legally resident in uk for the last 9 years and 8 months but exhausted all my rights of appeal on the 28th of may 2014.
I made an application on form flr ( fp) on the 19th of june based on private and family life. I have a british partner and we have been living together for just over two years. I have also had to stop working as my former PSW visa is no longer valid and have a letter from my employer offering to re-employ me if all goes well with my application.
Does my legal residency leading to the 10 years hold ? Please advise as I was thinking of making another application for the 10 year legal residency in September this year , which is when I would clock 10 years in the UK.

I believe that flr fp is his second application. So he was without visa when he applied flr fp. So no section 3c trigger.
Can he still vary his flr fp application to set (lr)?

thanks for your advise I was not 100% sure I could do this. But thanks for this once more.
As I applied for my flr fp 20 days after my refusal with no right of appeal would you suggest that I apply when i actually clock 10 years in the UK or as you advise 28 days prior.

does varying an application mean i just put in a new application on form set lr and let HO know that i have another application running? How does this work when i have another application?
Do i pay the full fee for the new set lr application?

Yes, you add a cover letter with the acknowledgment ref number from the other application asking for it to be varied with a completed SET(LR) application and any additional documents required. You should only be debited the fee difference.

Hi,
I have applied for ILR with SET (LR) on 17/6/14; received acknowledgement letter on 19/6/14; and received biometric letter today 30/6/14 and will do the biometrics today.
Pls do anyone knows the average waiting time after i have done the biometrics?

My biometrics were done in March, still waiting , average it takes 4 months i guess
Flro applied 23.02.14
Varied application to SET LR 3.3.14
Biometrics done 24.3.14
Approval 24.7.14
Docs received 28.7,14

hi
today 29.08.2014 i received ltr refusal with no appeal rights . I first came to the uk on the 26.09.2004 but received my visa on the 21.09.2004.
I posted my application to vary the ltr to long residency today . The letter of refusal came around 3.30 pm today at which time i had posted my application to vary leave.
Please advise what i should do now.
Also does my 10 year count from the 21.09.2004 or 26.09.2004.
not sure what to do now.

hi amber.
thanks for your response i went and sought legal advise and turns out JR is not a good idea.
anyway , today i have received a letter from the homeoffice responding to my flr(lr) application asking me to go for biometrics.
i made and flr(lr) as i am still yet to do my life in uk test.
So confused as i thought the flr(lr) application to vary my flr(fp) application would be rejected as they had already refused the flr(fp)
what are your thoughts on this? any advise? what does this all mean?

I came to uk in 2004 and my student visa was till april 2005,was training in a nursery and they made a TWES application before my visa expired.They never gave me any letter or response or took my passport,after detailed communication the school failed to apply properly and made my second application in 2006 which was unsucessfull and i extended my student visa after explaining all this to the home office which was in 11/2007.Now we are here for 10 years and want to apply for ILR in 10 years category.will there be a problem in our application can any one advise.
