Tier 2 General switching rules 2014

Post by Vinay78 » Thu Jul 24, 2014 5:19 pm

Hi I need clarification:

The latest rules are below for TIER 2 General switching...below are excerpts from the GOV.UK..Please advise if being in UK Tier 2 ICT holder can switch to Tier 2 General?

Switch to this visa

You can apply to change (‘switch’) from another visa to a Tier 2 (General) visa.

You should apply before your current visa expires.

Eligibility

You must already be in the UK under any of the following visas or schemes:
Tier 1 visa
Tier 2 (Sportsperson) visa
Tier 2 (Minister of religion) visa
Tier 2 (Intra company Transfer: established staff) visa and you’re applying to change sponsor
Tier 2 (Intra company Transfer) visa under the Immigration Rules in place before 6 April 2010 and you’re applying to change sponsor

What is your question? What is your current visa category? When was it issued/ applied for?

Hi All,

I am currently on ICT Tier 2 Long term Staff migrant Visa and I want to change my sponsorer.

I saw in the 2014 changes that are on GOV.UK website that now ITC tier 2 can switch to Tier 2 General we apply for change of sponsorer.

I wanted to confirm : Can ICT Tier 2 switch to Tier 2 General if we want to change sponsorer in UK.

T2 ICT can only change to Tier 2 general if the original entry clearance was applied for before 6 April 2011.

Hello All

I have got tier 2 General visa, sponsored by my current employer, which is expiring on 1 May 2015 ( I have been working with this employer from May 2012). They are ready to extend it.

However, I have got another employer who are ready to sponsor me and have issued COS but I have not applied for leave to remain based on this new CoS. Now my current employer has counter offered me and is ready to promote me and increase my salary, so I am thinking of not leaving them.

Can any of you please let me know if there would be any effect of CoS issued by new/prospective employer on the leave that I already have for my current employer (upto 1 May), and also whether my current employer can extend my leave?

Regards
Thanks.
