ILR - Dependent Visa query for my wife and UK born child

Post by send2chaitanya » Sun Jan 04, 2015 8:35 pm

Hi,

I was on Tier1 General got my ILR in November 2014. My wife is due to apply ILR as she recently passed her Life in UK and ESOL qualification. We got a child born in UK in September 2014.

I would like to apply ILR for my wife and child ASAP as we have travel plans this month. That is the reason I did not go through the British Citizenship for my child based on the statistics of the process completion is average 5 months.

Could you please suggest we can apply ILR on Premium Service. If so, which form I need to use for both of them (Set(O)?)
If it is Set (O) is my wife going to be main applicant?
What document is required for my child to apply ILR?

Your quick response would be highly appreciated.

Your UK born child should be able to apply for ILR or citizenship.

Under what category were you granted ILR?

Thanks a lot for the quick response!

I have been granted ILR under Tier1 General Visa(2009-2014) after completion of 5 years in October 2014. My wife is staying in UK along with me since 5 years. She is on Tier 1 General dependent visa which is valid till April 2017 (We had to go for an extension because of the shortage of 3 months to complete 5 years). All of our visa extensions were applied together.

With the above information, please suggest the correct form I need to use for both my wife and UK born child as I will be applying ILR for my child as well at the same time with my wife.

Thank you. As I asked in my first post, Is my wife going to be Main applicant of SET(O) and child is dependent?
The reason I am asking because there are main applicant details section in the form.
Please clarify.

I think we use this form for British Citizenship.
Is it not possible to apply my wife and child together using SET(O) form? The reason I am asking is because I am going to apply visa using premium service. So I am not sure, whether I can use MN1 form. Please advise.

I had a quick look at MN1 guide lines as well. It says about British Citizenship only. Please help.

If you want to apply British Citizenship for you UK born child use MN 1, fees is £669/- no need to apply ILR for child.

If you want to apply ILR it cost you £ 1493 and after that you have to go for MN 1 (£669) in this case you can put him on set O of you wife no need to fill separate form for him. Wife main applicant child dependent.

Thank you. This really helps!
Unfortunately I can't go for Citizenship for my child because of travel plans else i would have saved £1493.
