Current employer acquired by a new company

Post by justdopposite » Mon Jan 12, 2015 3:59 pm

Hi

My current employer/company is going to be soon acquired by a new company(a large private equity firm).

Will this have an impact on my current Tier 2 general visa ? and my company sponsorship licence ?

What happens when I extend/renew my Tier 2 G visa next year ?

I looked at the Register of Sponsors list today, and I can see both my current company and the future company(one going to acquire) licensed under Tier 2 General (A rating )

Kindly Advice.

Many thanks

ps. I was told it will be business as usual and won't have any changes to my current company name/structure.

Thanks Manci

My company will be a privately owned company and will no longer be a plc. I sent an email to my HR explaining the situation with the above links for reference, and asked them to report the new change asap via SMS ..this is the response I was given ..
Whilst the company will be ultimately owned by ABC(new owner), XYZ Plc remains as a company in its own right and you continue to be employed by XYZ PLC.
Therefore there is no change and I am certain that this does not affect your Visa but thanks for checking.
I have no idea what that meant ....Is my T2G visa still on the safe side?

if XYZ plc remains a company in its own right, and a T2 sponsor, there is nothing you need to do.

Eventual amendments to the company's organisation details should be reported by the company via the SMS

Thanks

It seems there will be a minor change to the company name , it wont't be 'XYZ plc' anymore as its no longer a plc , instead the company name will be just 'XYZ' , but still a licensed sponsor - is the XYZ company required to report this change?

Hi guys

I've got a similar situation but need your assistance on this. I'm working with Company A and they are sponsoring me for Tier 2 General Visa at the moment. Company A has been acquired by Company B and my current employer (i.e. Company A) is saying that, from 1st August, all employees will be transferring over to Company B as per the TUPE process. We are told that after the TUPE consultation, all visas would be transferred to Company B. This would be probably after the employees have been transferred to Company B, i.e. after 1st August.

My question is that: Would there be any issue if I'm on holidays and out of the country for few weeks in July and return to the UK after 1st August (i.e. the date of transfer from Company A to Company B). As I would still be on Company A's visa and not Company B's visa when I'm returning back to the UK after 1st August. Would this be of any issue with the Uk Border Agency?

Any help is greatly appreciated.
Thanks

Thanks for the link to the blog. It explains a lot of things related to TUPE in detail.
However, I can't find anything specific to my question. I need to know if Tier 2 visa holders can travel in/out of the country after the transfer date (i.e. the date of transfer from Company A to Company B) until the employees (i.e. Company A's employees) are transferred over to the Tier 2 visa sponsored by the new company (i.e. Company B).
