Dear vinny, thank you for your reply. Please note that I have read almost all the posts regarding toeic on this board last year and that's why advised my wife to contact ETS to verify her test reports. In sep 2014 she emailed ETS USA for verification purpose. They advised her to contact ETS uk. She then emailed ETS uk and received a verification form by email after a month of wait. She immediately sent them the completed form. After 5 months of wait she received an email from ETS uk with an attached letter stating that her speaking test scores are valid. Again after 6 weeks (total 6 months) of wait she received another letter from ETS uk stating that her listening and reading scores (tests taken at university of Westminster) are also valid. In this 5/6 months duration ETS has done the biometric voice analysis before sending the confirmation letter to validate the test reports. Now should we write a cover letter and include these ETS letters when attending the appointment? What do you advise? My wife is in the uk since April 2004 as my dependent. She was on tier 2 dependent visa from nov 2009 till July 2013 before switching to flr m visa. We have a child who is British citizen. She has been working at John Lewis for 7 years. Please let me know your advice on my wife's situation.

First of all thank you ever so much for your valuable time Vinny :D

They are pursuing this cause Government wanted to reduce the total number of immigrations by ten of thousands and they were failed .
They are using TOEIC as a weapon . Yes you are right they are wasting their time , tax payer money , wasting court time and destroying British people lives . For an example , Any EU national's spouse doesn't need any financial requirements to stay in Britain on the other hand British National's spouse does!! Its totally insane :( Law should be equal for everyone in a country . Even though if any EU spouse has overstay in his/her immigration history in UK they are eligible to apply spouse visa in UK ! British Spouse are not.
Are the British Government working on the behalf of EU national ? They have to be equal for every one . Should treat everyone same . How many British family are sufferer ? Lots!!! Im so sorry If I hurt anyone. But Thats the reality we are going through .

Do you know if my husband leave this country by his own and re-apply for new spousal, any doubt with this idea? We met all the requirement of spouse visa. I'm a tax payer, my husband spent at least 100k while he study in the uk, we never took a penny from government. It is really unfair. We just bought a house, we put all of our money towards deposit of our house. For this time, we don't have any money to go anywhere also even if my husband go back to his country, there is no place to live. We are together since 2009 and married last year but we don't have a children, is it count for family life? If not what about private life? He came to England when he was 17 and now is 25, many friends suggest him go back and re submit for enter. But we are worried about HO will refuse it due to toeic issue. :cry: :cry: :cry:

If I am in your shoe I won leave the country at first . I would First first. Yes as aBritish Spouse Home Office Can not Ban your spouse from UK Under 320(7B).
You need to discuss your issue with a good solicitor :)
I think there is enough grounds to fight against it this is my personal opinion .

TheUT's President, McCloskey J, has directed all ETS/TOIEC cases to be stayed pending the Court of Appeal hearing in Shabaz Ali on 8-9 July.

Therefore there is an present stay on removal, and stay on hearing of ETS cases at the lower courts , pending the outcome of Court of Appeal case above.


Those who have applied for Residence Card or under the Regulation, are covered by community law, and the UKVI has no right to refuse to issue or deal with such application pending the outcome of the Court of Appeal case.
