Canadian move with UK citizen spouse to Spain

Post by SpanishDreaming » Fri Jul 17, 2015 8:41 pm

I am looking for some clarification on the process of moving to Spain from Canada, as information on the internet has been quite inconsistent.
I am a Canadian citizen, engaged to a UK citizen, with a 5 month old daughter, whom all live in Canada.
We are planning to move to Spain in the New Year, but live in the UK for up to 6 months first to get married, and visit my spouse's family.
My questions are pertaining to the move from the UK to Spain. I plan to apply for the Marriage Visitor Visa to get to the UK which will give me 6 months there, before moving to Spain; what will I need to move to Spain?
I understand that the UK border may require flight into, or some sort of documentation confirming my leave to Spain before my 6mo period ends. The issue with this is we don't know exactly in Spain where we would like to live yet, my spouse has two potential job options in the provinces of either Malaga, or Valencia, so we plan to make visits to both regions during our stay in the UK before the move. Will the UK border accept a flight to one of those locations, we can schedule a one way and then just book our return once in the UK..if that makes sense.
Lastly, if we get married in the UK, I understand Spain will need a copy of the marriage certificate, and it must be dated within 3 months correct? What other steps will we need to take with the marriage certificate itself?
I understand I will also need health insurance, a police record of the last 5 years from Canada, a Medical clearance from Canada, and some funds correct? Does anyone know how many funds are needed? Or if anything else is needed to enter, and reside in Spain?
Will it be easier if my spouse moves first, confirms residence, applies for his residence card, then I move and use his residence card as part of the application to move?
I heard somewhere that if I apply for a visado reagrupacion (reunification visa) in Spain, it will make the process easier as my spouse will already have residence there. But the catch there is that I would need a social security number from the UK?
What will we need to do with our daughter? We plan to apply for her UK passport while we are in the UK - so if she has that there shouldn't be any issues with her moving to Spain correct?

I hope this all makes sense, just trying to make sure our move is as seamless as possible, but like I said, I seem to read different information, and requirements everywhere.

What do you think your canadian passport is good for?
6 month uk and 90 days in the schengen area (spain).

Check the immigration rules at Spain's government website. As a non-EU citizen, you'd have stringent requirements in being able to get permanent residence in Spain. But as the spouse of an EU citizen, you should be able to complete the requirements much more easily. Again, check with the Spanish consular section.

I am well aware of that, however that doesn't help one reside in Spain.

I have checked with the Spanish consulate, and tried to contact the embassy in my current city but I keep getting different answers. I was hoping to hear from someone who has done the move themselves, or has some experience with the matter.

Well, we're all just trying to help you. Not good to brush off suggestions and thoughts as arrogantly as you seem to have done.

No matter what people tell you about their experiences and anecdotes, the only accurate way to know what to do is from the government. Laws change, after all, and what someone tells you months ago may now be different in actual fact.

If you can't get the information you need from the government consular offices, there must be something about the way you're asking or seeking this information. Maybe it's your style.

Hi Fellow Canadian,

I'm in a similar situation. I'm Canadian married to a Scotsman. We got married months ago… but the time frame as to when you were married is irrelevant.

Here is a link to a guide to "Directive 2004/38/EC"… it states in plain language the EU law that allows you and your spouse to move to Spain with very few requirements.

http://ec.europa.eu/home-affairs/faq/fr ... _ec_en.pdf

You should educate yourself on it, as you may also be informing the border agents when you go through customs. It's a long read but well worth it, and it will easy your mind.

All you need to go to Spain is 1) Your Passport 2) Your Marriage Certificate 3) Your Husband. NOTHING ELSE IS REQUIRED for you to live or work in Spain. Once you move into your new home (have an address) apply for your residency card. This will make it easier to become employed as locals may not be aware of your rights.

My husband I will be moving to Spain as well, next year. So, I have thoroughly educated myself on what is needed. Now I'm no longer stressed!! :)

If your daughter is Canadian, you only need her Canadian Passport… applying for a UK one may take unnecessary time. If you are getting married in the UK, YOU WILL need to apply for a Marriage Visitors Visa to get married in the UK. It's required by law and you will need to show it when you give notice to marry at the registrars office.

I hope that helps.
-Sarah
