Tier 2 to ILR (start date and end date)

Post by alextkl831 » Tue Nov 21, 2017 12:18 am

Hi ALL,

I am vey worried about the start date and the end date given in my tier 2 visa, which may affect my application of ILR in the future.

In my CoS,
the start date is 16/10/2017
the end date is 15/10/2022 (five-year visa)
Then I submitted the visa application on 10/11/2017,
and result released with confirmation letter and stamped passport on 14/11/2017.
In the letter, it is clearly stated that I will have permission to be in the UK as TIER 2 (GENERAL) MIGRANT from 5/2/2018 to 29/10/2022, and my BRP will be available for collection from 12/2/2018.

Based on the above, I get 2 questions:
1. I noted that I have to work within 3 months after the entry clearance. Does it means that I have to work before 13/2/2018 (14/11/2017 + 3 months)? My BRP will be just available on 12/2/2018....
2. Why the tier 2 visa granted period is from 5/2/2018 to 29/10/2022 which is less than 5 years? Is it something wrong by the HO and should I make a contact with them? Based on the period granted, will my ILR application in the future be affected (less than 5 years......)?

Could anyone help me?.. I am very worried and can not find the answer on the internet.... :(

Thanks.

You pay IHS @ £200 per year or for part of a year.

Halo, thank you for you reply.

I pay IHS @ £200 per year for sure, but I don't know why the granted period is less than 5 years (count from the visa/ approved letter issued date). Please help advise what I should do, or does the HM make mistake on the period?

Thanks. :?

What start date did your employer put for you?

Was there any request or information that you are needed from 5th February??

Thanks for yr reply.

The start date on CoS is 16 Oct 2017
The end date on CoS is 15 Oct 2022

I query my employer about this start date, but he said this is tentative only and the actual start can be another, depending on when I got the approved visa. I am wondering that my end date of my tier 2 is 29 Oct 2022 because of the end date on CoS 15 Oct 2022 + 5 year 14 days? If so my start date of the tier 2 period should not be the issues date of the stamped passport as the period granted is still less than 5 years. What should I do then? Very desperate :(

By the way I got another question and hope u could help me. My granted date of entry on the vignette in passport is from 5 Feb 2018 and the collection date of BRP is 12 Feb 2018. If I want to enter and start work earlier (on Jan rather on Feb), what should I do? To do the vignette transfer? Or early entry and work are allowed?

Thank you for yr attention again :)

What did you put as your intended date of travel on your visa application?

For my second question, I put my intended date of travel on 13 FEB 2018 but now I want to start earlier. I visit the website and I understand I can apply vignette transfer if the vignette expired. So I dun know whether my case applies this situation.

Thanks for yr reply. :)

I am noy sure why you are surprised about the dates your visa was granted for, based on the information that was given. You said you would travel on 13 February so the visa was granted from beginning of February to give you some leeway to change your plans. The expiry is 14days after the end date your employer gave on the CoS. You were given the maximum visa duration based on the dates submitted to them.
You should have talked to your employer beforehand to clear these issues. If they needed you immediately (based on the start date they reported) you should have indicated your intendes travel date much earlier. If they don't need you until February, then why did they span 5 years from October this year? If not, why did you put your travel date as February? Regardless they will need to report change of start date on m SMS as you will not start as planned.
As for entering early I am not aware that this is possible. In my mind it would require a new visa...

Hi, thank you for yr reply.
So in this case my 5-year tier2 visa can not be changed anymore even if my employer reports my start date as you mentioned above? :(

I noted from the letter from UKVI that if I can not enter within 30-day period specified on vignette, then I have to apply replacement or so called "vignette transfer". Just want to have someone to clarify before I pay the fee ...million thanks!!

It is £168 for a vignette transfer but it is usually done to travel AFTER the 30 day one you have, i.e. after your 30 visa vignette start and expiry date.

Your visa was issued per your travel instructions and you can only enter the UK from the date that it is valid from.
