Applying for EC for WP after previous UK FLR refusal

Post by successatlast » Thu Apr 17, 2008 8:40 pm

I came to UK in 2005 and completed my course and asked for further extension in October 2007 for another course. Due to payment problem application was returned back. This refusal I got 22nd October and my visa expired on 30th september 2007. Resent the application immediately next day. Forgot to write covering letter as was too stressed out. They refused it in November and passport was sent to Enforcement.Asked for reconsideration and the reply was negative.Again asked for review which came back negative in Jan 11.Left for India on 16th after collecting passport from Enforcement which they did not stamp. The immigration officers asked me few questions and the allowed me to go after I showed them the Home Office letters.

In the meanwhile I found a job and my employer sent me a work permit for 5 years.I am in the process of applying for Enrty Clearance. How much of my previous refusal is likely to affect my new application??I hardly did any part time job and completed all the couses in first attempt.Could someone enlighten me whether I should submit all the documents of previous refusal along with explanatory note or just mentioning in the application form would be sufficient. Also my employer has provided me with the accomodation which he has mentioned in the offer letter. But there is no separate tenancy agreement.Would this be sufficient. These 9 months have been very tough for me.Kindly advise me on this issue. What are my chances of getting WP EC

Just explain the situation in as much detail as possible and so submit all the documents for EC purpose. You also should submit that you passed all the exams while you were on sudent visa and you were refused extention just because of payment problem.

I think you should be fine if you satisfy all the immigration rules for work permit. And even if you'll be rejected for EC as now a days ECOs blatently refusing any application with some complication, you will definitely have a good chance of appeal success.
