Will I be categorised as an overstayer...........kindly help

Post by successatlast » Fri May 16, 2008 10:13 pm

I have made an application for Work Permit EC last month and when I asked them about my status yesterday they said that they are doing verification and when I asked about integra they said no it is different verification. I was prviously refused FLR and so I submitted an explantory note and all previous refusal letters from Home office along with my application.

Kindly consider my timeline for previous refusal and let me whether I will be called as an overstayer.
First application was submitted when I had leave to remain. It was returned back after 22days saying invalid application.Sent another application next day and refusal came in another 3 weeks time.Withing 7 days applied for reconsideration. It was refused after 1 and half months.Passport was sent to enforcement. The person there said that it is a case of simple refusal and gave the passport back to me without signing any removal papers or marking it.This whole process took 3 and half months.I left within 14 days after receiving my last refusal.

Can all the Gurus and Experts on this forum kindly tell me whether they would consider the last date of the corresponce with the home office or the first time they refused me to put me under overstay category.Kindly help me so that I can be mentally prepared for the news.Plz Plz help me.

As long as the Home office were still considering your application and you then left the UK within 28 days of receving a refusal then you would not be classed as an overstayer.

Unless you have more information to divulge...? Like for example did you leave voluntarily or were you removed..?
Oh, the drama...!

Thank you for your reply.I left UK voluntarily. At the Enforcement Office my passport was given back to me and no removal notice was served.I did not sign any removal papers. The Officer at the Enforcement said that mine is a case of simple refusal and gave the pasport back to me.He showed me the passport before returning it and said that they have not marked anything.I received last refusal on my reconsideration request to the Home Office on 10th Jan 2008 and I left UK on 19th Jan.Plz help!

Just to add I received my first refusal on 19th November 2007 and I applied for reconsideration on 21st November.Thank you.

You are in the clear. Nothing to worry about but keep all the paperwork in case it becomes an issue if / when applying again.

The fact that the Enforcement Officer returned the passport seems a bit odd. Did you have a plane ticket to show him your depature date?

If not you were very lucky :D

Thank you so much for your kind reply.I had handed over my one way ticket at the enforcement. They confirmed it before giving back the passport.

Today my status has changed on the VFS website. But I have no clue about integra, no medical papers were sent and also I was not invited for interview.I am very anxious as I expected at least an interview call as I had previous FLR refusal. At least medical papers as my work permit is related to medical field. Are all these negative indications.Kindly help.
