ILR application date and query on my Tier 2 grant period

Post by alextkl831 » Sun Jul 12, 2020 3:10 pm

Hello, I am not sure if here is the right place for me to ask the questions - apologies if not. :)

I'm the current Tier 2 (general) visa holder. The background of my case:
The date of receival of the letter from UKVI mentioning my application for a UK visa has been successful: 14/11/2017
The date of entry to the UK: 6/2/2018
Visa expiry date: 29/10/2022. (it is the 5-year tier 2 visa type)

My questions are:
1. If I apply for the ILR in the future, what date should I calculate from? (I've read through other posts and apparently I should back-calculate the date from 14/11/2017 in my case.)

2. My current Tier 2 visa is 5-year type, but I can not work out why the end date of my visa is 29/10/2022. This makes me worried because in this case even though I consider 14/11/2017 as the first date staying in the UK, I will not be able to tell I have been here for 5 years when I apply ILR. Does someone have an idea how 29/10/2022 was worked out, and whether this will cause a big issue for my future ILR application (i.e. not stay here for 5 years before applying ILR)? I forget the date of application of visa (i.e. the date to submit the document to UKVI).

Thanks very much.

1. Your qualifying period starts from initial visa issue date, so 14/11/2017 if that is the date your visa vignette was valid from.

2. This was all explained to you when you asked the question previously. You get 5 years, inline with the cos end date, plus 14 days. You cannot get more than that and what is stated in the cos. Reread your precious topic. You can apply for ilr within 28 days before the initial visa issue date.

Thanks very much for your quick answers. I still have two more follow-up question after thinking carefully..

1. I gather that I can apply for ilr within 28 days before the initial visa issue date. However, there is less than 5-year time between 14/11/2018 to 29/10/2022 (short of 15 days to reach 5 complete years....). The question sounds a bit stupid: will this (less than 5-year time of the stay) block me for applying ILR?

2. 14/11/2017 is actually the of receiving the letter from the UKVI releasing the application result, while the valid date of my visa vignette is 6/2/2018. I assume I can consider the gap between 14/11/2017 to 6/2/2018 as the qualifying period (less than 180 days) from what I catch on from other posts/ HO's document?

I just want to me get myself reassured that I will be fine in my case - cheers :)

1. There is no requirement to have a valid visa up to or last the 5 year mark. Ho do know the rules.

2. You qualifying period starts from the date in your visa vignette. If that is only in Feb 2018, then that is your start date and you will need a tier 2 extension to cover the shortfall.

It is pretty sad if this is the case. I've never expected that I need to extend the current visa for just a few month as I find the answer "you can apply no sooner than within 28 days of the 5th anniversary of the initial visa issue date" from other posts.I also thought the date on my visa vignette is just showing my intension of when to enter the country...

I am digging into the document in the link below and I couldn't see the date on the vignette is the date that I am looking for. If convenient, could you please advise me where this (the date on vignette is the start date of counting 5 year) is from? Thanks for information anyway.

29/10/2022 must be the end date given in your certificate of sponsorship COS document

Page 10 of the document where it states the period between entry clearance and arrival counts towards the qualifying period.
