Application Section 3 2 Parent Descent Application Abroad

Post by mn1applicationmexico » Tue Nov 14, 2023 8:25 pm

Hi everyone,

I just submitted the MN1 British Citizenship Section 3(2) application for my daughter recently born in August in mexico. I am a British Citizen by descent (I was born in the US, British parents born in UK) and her father is Mexican, my daughter was born in Mexico.
I sent the application online for my daughter via section 3(2) (Your parent is British by descent and lived in the UK or a British Overseas territory for at least 3 years before you were born.)

After making the payment, I have to send the documents via post. Is this normal? I was hoping I would be able to upload them rather than having to send original documents? But there is no link to upload online and it specifically states to post the documents.

If I do have to post the documents, am I able to provide a copy of my passport as proof of my british citizen ship? I cannot provide a birth certificate as I was born in the US, hence the need for the application.

For the other documents needed, I understand I can send copies? If I send originals, do they return them?

Thank you in advance so much for your help!!!

I think you need to provide your parents' birth certificates or something along those lines, and your birth certificate - that will show that you are entitled to British citizenship by descent. Other members may offer more clarification on what documents you need in your case. If the application asks you to send originals, then that is what you will have to do I am afraid.

Thank you! Yes I have a few documents to provide such as birth certificate etc which is all fine!

Im mainly wondering if its normal to have to send everything physically rather than online...as I don't really want to be in a foreign country without my passport for 6 months!

That seems to be a normal requirement. Clearly it is difficult to verify that document scans received from abroad are actually from genuine documents. Applicants within the UK upload documents but UKVI occasionally request originals during processing.

I may be wrong, but I am not sure you need to send your own passport - see https://assets.publishing.service.gov.u ... t_2023.pdf (updated last month) page 25

Evidence of identity
Either:
• Child’s passport or travel document
• Child’s birth certificate, showing the parents’ names
• Driving licence
• Bank, building society or credit card statement issued to them in the last 6
months.
Child born abroad to British citizen parents
Provide the following:
• Child’s birth certificate showing the parents’ names
• Parents’ marriage certificate (if the parents are married and the father is a
British citizen)
• British parent’s birth certificate or passport
• British grandparent’s birth certificate, registration or naturalisation certificate or
passport
• Grandparents’ marriage certificate
• Evidence of residence
o Section 3(2) – evidence that the British parent lived in the UK for a
period of 3 years at some time before the child’s birth
o Section 3(5) – evidence that the child and both parents have lived in
the UK for 3 years immediately before the date of application.

It is stated here you can send your birth certificate instead of your passport.

OP states he doesn't have a birth certificate as he was born in the US.
Though I would have thought they do issue birth certificates.
