UK Tier 1 General Visa extnsion : NI deductions

Hi ,

I am applying for my my Tier 1 extension, I came to UK in Feb2011 and prior to that I was in India(employed by the same employer).
My query is re the NI deductions- my employer deducts the tax as applicable but there is no deduction towards the NI (though I have NI Number). My UK pay slips show all components of salary along with tax but no NI deduction.
Kindly let me know if I need to produce an evidence from my employer as why NI deductions are not done in my salary slip?

IMO it is the responsibility of the employer to get the NI deducted from all employees salaries. If the employer is not deducting it for any reason I am sure he/she would be able to say why???

what is yr salary , if is less than NI thresold than nothing will be deducted from yr salary

Your employer is responsible to deduct appropriate tax & NI via PAYE. If he don't then it's a fault on his part not you. But still you will loose your entitlement for benefits covered by NI. Be cautious!!

IT IS ALSO APPlicants obligation to keep track on his tax affairs

if employer is not giving pay slip inform hmrc

not paying yearly or after reasonble time paye, inform hmrc - P60

REMAINIG aloof or ignorant is not accuse

if some one on t2 and employer not paid ni taxes , that call visa terms broken

applicant will loose ILR and going home , employer will go gail

Hi,

Although I am not an expert in tax&NI matters, still you can read this to know how the NI is calculated.

Since you entered in UK towards the end of the financial year, you might not have crossed the threshold for NI. I have seen the salary of many of my friends working in Indian offshore companies where the company starts deducting NI only after certain number of days after the employee enters UK. And I have certainly seen these friends getting their Tier1 visa and even ILR.

So you should not worry as long as the NI number is mentioned in your salary slip. Further, if this employment is your only source of income, then any question on NI deduction will go to your employer and not you.

At the same time, I would advise you to clarify this from your finance dept.[/url]

My offer letter says that NI deduction will start from the 53rd week of the employment in UK . first 52 weeks are exempted as i beileve there is a sop which Indian IT companies get from UK.

so even though the deduction is not mentioned , I am safe. Pls confirm.
