Does period for appeal breakes continuous lawful residence?

Post by gazijazhar » Tue Jan 28, 2014 9:54 pm

Hello everybody,
This is my situation:
- Came in the UK as a student in Sep 2005.
- Been on student visa until October 2011
- In October 2011 refused for post study work visa
- Submitted appeal on the time and attended appeal in December 2011
- In January 2012 the court decided to grant discretionary visa based on article 8
- Received visa in April 2012

My question is am I still elligible for ILR based on 10 years continuous lawful residence due to the appeal period and discretionary visa?

Thank you

Yes, it would appear so.
