Hi,

We have been blessed with baby boy and we are currently on Tier 1 . We have to get one more extension and we will be eligible for ILR in Nov 2014 .

Do I need to get Indian passport and tier 1 dependent and then ILR for my son or I can straight way go for British passport for him once we have ILR in 2014 ?

I am confused because I have read in this forum that parents needs to have ILR status at the time of baby birth for baby's British citizenship .

We are not planning to travel until Nov 2014 .

child born to ilr parents are direct british and child born to parents who are settled after birth of child are indirect british means a little lengthy process after getting your ilr apply for child registration on mn1 by section 1(3) and then u will get certificate using that certificate you can apply for child british passport .and there is no need for child dependent visa .we did the same waiting for our kids registration certificate applied dec 13.

If you are not planning to travel then you can wait for your ILR. Once you will get ILR then you can register your baby for british citizenship. Indian passport and dependent visa are required in case you plan to travel with baby before your ILR application.

One more question ; If I just get Indian passport for baby for any emergency travel to India then can I take my son to India without Tier 1 dependent VISA and then get his visa from India before coming back to UK ?
