Return of Documents: Non-critical...but critical

Post by Ninjoe42 » Mon Jan 25, 2016 12:08 pm

Hey folks, hoping someone can help me out here.

I was recently denied a Dependents Visa, very sad, but my partner and I plan on returning home to the US and reapplying as a married couple (she's here on a student visa). The problem is the Home Office still has all the stuff we used to apply in the first place!

I spoke to my voluntary leaving case worker, and he's never heard of someone wanting to get their stuff back. So he gave me a home office number, I called that and was given another number, I called that and it told me to go to the website https://www.gov.uk/visa-documents-returned. THAT says I can't use their request form if my visa was refused, and that I should "Follow the instructions on your refusal notice or contact the immigration compliance and enforcement (ICE team) in your area."

The refusal notice doesn't HAVE instructions, and the ICE team doesn't have a contact number. Trying to look them up results in being told to call the voluntary leaving office...who forwarded me to my case worker T_T

SO. In the application instructions it says that only ORIGINAL documents will be accepted, no copies, so they HAVE all our original documents. Those are, shockingly, the only originals we have, and we need them to make another application. Can I get my stuff back? Do they really want to keep my Christmas cards? I LIKED that photo I sent them dangit!

Any help would be appreciate :)

If it's absolutely urgent then you could apply to the US embassy for an emergency passport. These can normally be issued very quickly, e.g within a couple of days. It will let you return to the United States, but you'll obviously then have the trouble of getting your original passport returned to you. This might be difficult depending on your accommodation situation in the UK, although it may be possible to get UKVI to send it to the embassy and then they could get it to you.

Maybe try some of these links? (just check the dates).

The reason is after a refusal you're supposed to tell them when are where you're leaving from and they give you back your passport at immigration at the airport.

Something similar happened to a friend from the US, they just got an emergency passport and left. On the other hand they weren't coming back. You'd need a full passport to apply for a spouse visa, so not sure.
