Previous immigration history and Tier 1 application.

I am applying for Tier 1 visa and had a query regarding the previous immigration history.I am presently on work permit and my documentation is pretty straightforward for Tier 1.

On the application form there is a question whether you ever overstayed in UK.Before I got EC my visa was refused coz I could not change my category from within UK.After my visa was rejected I had applied for reconsideration on two occasions which was refused.I successfully got my EC from India.But because of the time involved in the process of nearly three months would I have to write yes for the question on overstaying.Kindly help.

No, if you had appealed the earlier decision (refusal) and left UK voluntarily after the final (appeal) was dismissed.

The fact that you were granted EC in India means that you were not in breach of immigration rules.

Mention the refusal and explain (clearly) in your cover letter that you had appealed the refusal and had stayed in the UK until the final decision on your appeal was reached. Include exact dates - refusal, appeals, and exit in your explanation.
