Student visa (Death)!!!!

Post by rp2247 » Mon Feb 07, 2011 4:31 am

My cousin got her dependent Visa from her husband who was a student and recently he died. She is not in a state to inquire about her status. I am worried as to what steps she has to take to save her status and live there legally. Does her visa expires immediately? What are her alternatives of staying in UK? Can she get her own student visa?

I would really appreciate if somebody can give me this information. It would be of great help to her and this is the least we can do for that women.
plzz let me know.

Following the main migrant's death, dependant visa is no longer valid and the dependant should leave UK at the earliest convenience.

The dependant may apply for entry clearance as a Tier 4 (student) if he/she qualifies for it.

Can I switch into the Tier 4 (General) student category?

You can switch into Tier 4 (General) if you have, or were last given, permission to stay in one of the following categories:

* Tier 1 (Post-study work)
* Tier 2 (General)
* Tier 2 (Intra company transfer)
* Tier 2 (Minister of religion)
* Tier 4 (Child)
* prospective student
* student (under the rules in place before 31 March 2009)
* student re-sitting an examination
* student nurse
* students writing up a thesis
* student union sabbatical officer
* work permit holder
* postgraduate doctor or dentist
* Science and Engineering Graduates Scheme
* International Graduates Scheme
* Fresh Talent: Working in Scotland Scheme

She was on a student dependent visa, I dont see that on the being able to switch incountry list (above)

She is now overstaying which will just cause problems in the future if she did want to come back, if the family encourage her to stay and break the law, this will almost certainly end in tears.
