Dear amber,

She is here on the basis of "dependent of a settled" i.e I had an ILR when she was granted an entry clearance.

yes, it will be refused as you were not physically present in the UK on 31st Dec 2008. this is an unwaivable requirement that you must satisfy otherwise the application will be refused. so even though you complete 12 months ILR on 28th Dec 2013, you need to wait until 3rd Feb 2014. ps: I hope you ...

Thanks for the suggestion and I agree that safest option is 5th Feb 2014. But I have heard (not sure how correct it is) that it doesnt matter if my eligibility day falls over a weekend so I'm open to suggestions if there is any kind of discretion that applies here, I would like to know.
