Hi cbxx82,

welcome to the forum :!:

First, I´d like to ask you to change the subject of your thread >>as per these suggestions<< (=away from "Urgent question").

To answer your question, we need to know where both of you lived at the time yee got married and ever since...

Regards and good luck,
Christian

we are currently living in canada and have been or the past 3 years. I am here on a student permit and my wife is here on a live in caregiver program.

we are applying for our residency together for canada in sept but the whole porcess takes 2 years so we want to come back to ireland and wait for it.

What options wil she have when we come back to ireland. what is she intitled to in ireland?

thanks for the reply

Had you been living in any country in the EU but outside Ireland you would have European rights, which would be more favourable and I could quote them for you.

Since you are Irish, your wife will be treated by Irish (national) rules, and I have no idea what they are.

If you want to move to any other EU-country than Ireland you can easily do it, since your wife would be treated according to EU rules there. Would you consider, for example, the UK, Malta or Cyprus as English-speaking EU-countries, or maybe Spain which might be appealing for your wife? If you want to know about the EU-route, just ask.

BTW - The low turnout of replies is probably due to the generic topic "urgent". Please do change it, as per my previous suggestion. You´re really losing out on replies there! Bad luck for you - not for anyone else...

Good luck, Christian

CB - your wife is Mexican, so she does not require a Visa to come to Ireland. when you arrive, you can go to your local immigration officer with your marriage cert and proof of your joint residence in Candada, joint finances etc to back up the bona fides of your marriage. The immigration 0fficer should give your wife an unreastricted residency stamp (with the right to work without a w.permit). The officer MAY require you to write in to the INIS (Dept Justice) with all your documents for them to officially assess your application and grant your wife permisison to remain with a letter from the Department. either way I think you would be fine.
