Hello there,

Somebody I know is a doctor and have been on a skiller worker for the last 5 years and here is what the timeline looks like:

Date of first entry in the UK: 01.08.18

Applicant worked for 3 different trust during the last 5 years.

Below are the questions:

1.As of Today(15.08.23), can Applicant apply for ILR as they have been here for more than 5 years ( I was reading that applicant can apply 28 days before the end of 5 year anniversary)?

2. Since the applicant worked for three different trust/companies during the 5 years, is the applicant required to provide list of days absent from work for all the three Trusts/Companies? or only the current company applicant is hired at the time of ILR application?

3. Employment Letter : Will the employment letter confirming Applicant's work status be only required by the current employer or for all the employers applicant have worked for? I am aware that current employer should also state about the SOC code, applicant's current salary, applicant required for foreseeable future etc.

4. How many days applicant need to be absent during the 5 years? is it 180 days in any of the 12 months?

1. The 5-year period starts from the very first visa issue/approval date. The date of entry is irrelevant for this route. He can apply within 28 days of completing the 5 years

2,3. All absences from the UK in the last 5 years must be declared on the form. However, a sponsor letter is only needed from the current sponsor. See: All you need to know about the sponsor letter for Skilled Worker route

4. It is max of 180 days in any 365-day period

All clear apart from point 2. Applicant will declare all the holidays/absences on the form. Question is if a letter is required from the trusts/companies mentioning these holidays and that they were approved/authorised by them?

HO learns from the process too. Over time they do understand difficulties faced in trying to get the simplest of things/documents from previous employer(s) hence why it is only from current employer applicants are required to provide such evidence as in your query.
