So, your husband is "present" in the UK but not yet "settled". Therefore, the reference to "present and settled" does not apply to your spouse.What is present and settled?
'Present and settled' means that one is settled in the UK (i.e. - has already been granted ILR) and, at the same time that an application under the Immigration Rules is made, is physically present in the UK.
Thnx for your help. Can you kindly advise me that wen my husband apply for the 10 years category then which option i shud select as his form says that i shud use FLR(M) to apply. Civil partnership is a term used for marriage between same-gender people.
