Dependant of ILR applicant (long residence)

Hi,
I need sum help regarding my application as a dependent under the 10 years category.

1. I understand that my husband can not include me in his 10 years application and wud not be mentioning me anywhere in the application.
2. We have read the guidence and it says that dependents shud complete (FLR M) form.
3. We have read the form and very confused on sum sections so plz help.
4. Section two of the form asks about partners details (Does my husband needs to complete this section?)
5. I am very confused on how to answer section 4. We have tried but do not understand it. It says,

I know my category is "Spouse of a person present and settled in the UK and biometric immigration document"

Under this it says " Is this the first time you have applied for a visa or extension of stay in one of the above categories (but not as a fiance(e) or proposed civil partner) with your current partner?" YES/NO

Now i am not sure how to answer this as my situation is as follows,

I came as a PSW DEPENDENT and recently changed to Tier 4 student dependent. Plz help on this one.

6. Also i do not have any english test but i am not sure if i need one to apply for an extension.

I wud appreciate for your help and advice as we can not afford to see a solicitor cuz saving money for the application.

Plzzzzz help....

Your spouse has not yet been granted settlement so he is not yet a "settled person". With that in mind, answer Q4.1 (and the choices above Q4.1).
English requirement - Perhaps

1. Thnx for your advise but i am not sure wat do u mean there are 4 options and i can only see two applicable to me which are (Spouse/Civil Partner).

Now if my husband has not got the settlement yet then which option i choose as both options say "Present and settled in the UK".

I have to say this form is very confusing...

R u saying that i will have to have an English test?

What is present and settled?

'Present and settled' means that one is settled in the UK (i.e. - has already been granted ILR) and, at the same time that an application under the Immigration Rules is made, is physically present in the UK.
So, your husband is "present" in the UK but not yet "settled". Therefore, the reference to "present and settled" does not apply to your spouse.

Civil partnership is a term used for marriage between same-gender people.

Thnx for your help. Can you kindly advise me that wen my husband apply for the 10 years category then which option i shud select as his form says that i shud use FLR(M) to apply. I am confused and more confused and hop u can clear thing up.
