Child born in UK, not included in ILR application.

Post by Jaissvega » Wed Mar 05, 2014 11:11 pm

Hi ,
I applied for ILR application on 1st March 2014 at Liverpool PEO along with my dependant wife . Got the ILR. Didn't included my UK born child on this application. I had planned to apply for his British citizenship under section 1(3) MN1 form. However, this may take another 3 to 6 months to go through the complete process. Things have changed quickly and now I have to travel to India with my family within the next few weeks. My uk born child's leave expires on 23 March. Can I now apply for ILR for my child using the SET(F) form? Any suggestions and guidance would be much appreciated. Thanks.

Yes. You could also apply for his/her registration as British now and it can be processed whilst you're on holiday.

Thanks Amber. I ll book another PEO appointment at Liverpool and submit my sons's application for ILR using the Set(F) form. And at the same time apply for his BC registration.
You guyz are doing an amazing job. Really appreciated.
I ll provide some more details about my ILR application here , it might help someone who is in the same boat.

Date Applied : 1st March 2014 at Liverpool Peo ( Current leave would have expired on 23rd March2013)
Category : Tier 1 General
Status : Limited Company Director, Worker and Shareholder
Documents provided : LIUK test for my wife and myself. ESOL Speaking and Listening Certificate for my wife.
8 Months payslips and Dividends vouchers stamped by accountant
Accountant Letter confirming the salary and dividends taken
Personal bank statements highlighting the salary and dividend payments
Business bank statements highlighting the same.
Invoices/remittance from the recruitment agency for the last 10 months
Letter from my account manager at the recruitment agency confirming these invoices payments#
Had just 70 days of non work related absences within the last 5 years qualifying period. So, just prepared a simple letter confirming the same.
Evidence of cohabitation : Council tax bill for last two years, tenant agreement for the last year, random joint bank statements covering the last 2 years, and couple of utility bills

That's all. Had loads of other documents, but kept them in the seperate file. Wanted to keep the application simple . Infact, the only question the case worker had asked was that she just need to see the salary that I claimed highlighted in the bank statements.

Any questions, please ask.

Thanks

Hi,
Just went through the new UKBA site again and it seems that the SET(F) is applicable only if the main applicant had settled using different route and not Tier1 (Work related routes). And if you check the eligibity by selecting the Tier1 route, it says the child can apply for ILR but specifies no informatiom about the form. It just assumes that you have to apply for the child dependant in your intital alllication on the Set(0) form. Can someone clear this confusion if they have applied using the SET (F) for their dependant child ILR and they have settled in Tier 1 category?
Or I should go ahead and book an appointment and submit the SET(F) form . They can refuse it and refund the application fee except for booking fee of £100 ?

Thanks

If both parents are settled SET(F) is acceptable.
