Hi All,

I am writing to you in the hope that somebody can answer my query as illustrated below

In brief, I am a Tier 01(General) visa holder. I got my visa clearance on 08.11.2010, it was valid till 08.11.2012. My first entry to the UK was on 05.03.2011.Currently, I am having Leave to remain valid till 28.01.16.

My query is:-

• Will I be eligible for applying for ILR by 28.01.16 or by 28.02.16? or I will be needing for another extension ?

*Period of Absences from U.K

17.07.2013 - 04.08.2013 = 18 leaves
29.03.2011 – 18.05.2011 = 49 leaves
Total – 67 leaves

I appreciate your help in advance

Hi

I would be saying No. The rule is very crystal clear that you have to be in country for 5 years (absence for holidays and work are excluded). Your first entry in this country was on 05.03.2011. The 5 year period will complete on 05.04.2016. If your leave is expiring on 28.01.16 then you have to first extend it then apply for ILR.

If your leave was expiring on 28.02.16 then it would have been easier but you are still short of 37 days.

As per my knowledge you can't apply for that day. But if your current visa was issued till 07-02-16 i.e 28 days earlier for your qualifying period i.e 07.03.2016 then you might able to apply. So you are short of 9days for your qualifying period. I dont whether you can apply via postal to delay some time to get qualified. But postal application will taking time i.e approx 6 months min.

Other wise you can extend your visa now only. so that you can save some money, Because visa fees are going to increase from 6th of april...

Thanks alot for all your reply ...But In case I won’t be eligible to apply for ILR by this time could the Home office make an exception for my case and accept it in case there were extraordinary circumstances beyond my control banned me from travelling to the UK at the planned time I had proposed before.
In brief, after I received my visa clearance I booked an air ticket to Heathrow airport for 04.02.2011.And as I was under the reserve army forces at that time, I went to get travel permission from the local civil registry office. They refused to issue me one and I was told that I have to put myself on a military trial claiming that they had notified me to attending some obligatory army calls and I missed them. This allegation was not true and after attending several trials the judge proclaimed my innocence. But, this of course affected my planed traveling date and shifted it to 05.03.2011.
What makes the matter worse is that during my trial period, my home country (Egypt) was in a chaos and mess state after the revolution of 25.01.2011, and the Army was declaring the state of emergency which made the procedures of issuing the travel permissions much slower than usual and affected badly on the airlines. Lots of airlines were cancelled and the air booking centres were closed. The whole matter was out of control.
Please note that I still have the confirmation booking e-mail I received for my booking to the UK on 04.02.2011 and I may be able to get an official evidence from an authorized institute.
