ILR application through SET ℗ route

Post by deebee » Thu Mar 06, 2014 4:54 pm

Hi everyone

Thank you for taking the time to read my post. I am in desperate need for some advice please.
I was granted limited leave to remain for 5 years in 2005, my visa is due to expire this June 2014.

Since receiving my limited leave to remain I have completed an undergraduate BA honours and I am currently studying a postgraduate MSc degree that ends this September 2014. I have been married for 2 years now and also have two children now aged 3 years and 9 months. Both my husband and children are french nationals, the kids were both born in England however.

Right, so my question is if i am eligible to apply for ILR as of May 2014 is there any other route I can apply for ILR apart from the SET ( P ) route?

I am currently working at the moment although I had reduced my working hours.
Please advise me if there is an alternative route I would be eligible to apply through?

Secondly if the protection route is my only way, for those who have knowledge regarding this application; What evidence can I attach to strengthen my application as the form is rather vague and does not ask for much?

Thank you in advance.

You mention your husband is French and children are French national so you have got option to apply for resident permit as spouse of EU national. And next year where you clock 10 years you can apply for ILR on long residence route if you want using SET (LR) form.

On what ground your previous limited leave granted for, Was it humanitarian protection? and you say that was 2005 and the leave is going to expires in June 2014. Can you clear what visas have you been holding throughout these 9 years. If you current visa was granted on 5 years humanitarian protection yes you will be eligible to apply for ILR using SET (P) form.

@ Seneca, thank you for your prompt reply. I will definitely look into appealing as the spouse of an EU national.
Yes my previous limited leave was granted on humanitarian protection act; this was from June 2009- June 2014.
By any chance would you know what type of evidence I would have to attach to my application? The form does not ask for any proof of address, bank statements or pay slips etc.

Form doesn't ask for payslips, bank statement or proof of address. They ask for the documents below. But if you wish to send others documents you think will help your application do so.

i. Current national passport(s)
ii. Travel document(s)
iii. Immigration Status Document(s) (ASL.2151, ASL.2152 or ASL.2150)
iv. Relevant Birth or Marriage certificates
