Refused Visa Need help for Re apply.

Hi All,

Me and my partner has applied visa on the basis of 50k Category , our visa refused with the reason that business is not consider in NQF LEVEL 4 and above because we show online trading business.

after we realize that it is true that online trading business not fall under NQF LEVEL 4 AND ABOVE. so HO decisions is right for refusal ,

After refusal we have rights of appeal and our court hearing date is 4th July 2014.

Now we want to re apply with new consultancy business

so my question is

1. can i make new application with same existing company ? ( if i change nature of business trading to any consultancy.)

2. do i need to create new company to show new consultancy business ?

3. When can i apply new file ? ( after refusal appeal or withdraw appeal )


dear friend pls suggest , which is the best way to re apply

Hello taral,

Though you made a big mistake but there is one solution left for your case. You can reapply while your appeal in process ASAP & withdraw your appeal once application lodged.

1 & 2) Yes you can use the same company depends what nature you have chosen. We had our cases granted visa after reapplied we opened new companies for them. again depends how old is your company etc.

3) you can not win the case at all under the circumstances of your company level. If any solicitor or barrister say yes then i am ready to challenge him/her.
