Withdrawal of ILR Appeal

Withdrawal of ILR Appeal

I and my Mrs applied for ILR and my Mrs application was successful. My application was rejected since there is a break in my 10 years of lawful residence. I lodged an appeal against the home office decision.

I feel I stand a better chance of success if I apply for an FLR(M) application now that my Mrs is a settled person.

My question is if I withdraw my current appeal on ILR and submit an FLR(M) application, would I be entitled to an appeal in the event my FLR(M) is unsuccessful?

Please could someone give some advice?
