Hi,
I have been going through the posts and reading extensively,
I am a PBS migrant who has now ILR and my dependent has 3 weeks shortfall.
From what I can see, the forum gives 3 options,
1) Apply by the post and hope for the best,
2) Vary application
I have my doubts here
https://www.gov.uk/government/uploads/s ... edures.pdf
Here on page 36, it states:
The application date remains the date of the original application and not the date of the
variation.
So since the date is the same as the original application, what is the point?
3) Extend after receiving extension, apply ILR again.
As per recommendation from my immigration advisor, I am planning to apply directly with Set(o) form.
We have already history in the UK prior to dependent visa, so we are thinking we can get away with this.
What can go wrong here? Again my immigration advisor states that we have done this many times in the past, worst case they extend the visa but as the application will take long time to process, you are good to go anyway.
My concern is if they extend, under what category will it be? Also I don't want my wife to be switched under different category with different settlement rules.
Please help as visa expiry date is very near now.
