I applied to switch from Post study work visa to a Tier 1 Entrepreneur visa in June 2013. My PSW Visa was to expire in August.
I worked through an agency as a contractor for 3 months with a reputed charity and then won the contract directly through my business.
My application was rejected in August 2013 due to my clients contract not having an email address and telephone number even though I had provided their postal address. The refusal letter clearly stated this was the only reason to refuse my application.
I appealed against this and my appeal was refused on 4th of April 2014. I have requested permission to appeal against this from the UTT. My lawyer states I should be ready to make a Fresh Application.
I have read through the policy guidance and it states this:

59. You must also have £50,000 of your own money available to make a fresh investment into business in the UK, and be established in business in the UK as a self-employed person or as a director.
i. Applying for leave to remain
You must be in the UK and be applying to switch to Tier 1 (Entrepreneur). You may not use section d (see the attributes table for initial applications) if you are applying for entry clearance or leave to enter.
ii. Last granted leave as Tier 1 (Post-Study Work) migrant
You must have last had leave as a Tier 1 (Post-Study Work) migrant.
iii. Registered with HM Revenue and Customs (HMRC) as self-employed; or registered as a director
You must have been registered as self-employed or a director of a business within the last 3 months before submitting your application as a Tier 1 (Entrepreneur). If you were registered earlier than this you will still need to provide evidence that you were registered in this period.
Could someone please let me know:
1) Am I able to use my existing business to make the fresh application? How do I go about proving this

2) Am I able to continue working if the UTT rejects my permission to appeal? (This is because my PSW expired in August 2013 and I would not under appeal and I will have 28 days to make a fresh application)
