Application of ILR

Hi All,

I would like to apply for ILR, but i didn't stay in UK for continuous period but I was working for the same project. please find my details below.


2007 Oct to 2008 Jan - London
2008 Sept to 2008 Oct - London
2010 June to till date - London

During the other period time I was working outside UK for the same project.

Can you pls tell me whether I would be eligible for ILR.

Thanks for your reply . Sorry I forgot mention my visa type is Tier 2 (ICT Long term) visa. I came on 2007 and then I was on and off outside UK for same project. And again I was back on 2010 June and there after I am continuously here in UK.

According to the below statement:

"Absences must be for a reason consistent with the original purpose of entry to the UK"

I have entered UK for a project requirement and I worked outside UK for the same project requirement and again came back to UK for the same project requirement.

If my understanding is correct, I should be eligible. If that is not the case, Could you please let me know .

qualifying period for dependent of a settled person (10 yrs)

Could any one please make this clear? as below
Settlement criteria for dependents of Long residency
I obtained entry clearance UK visa on 15/02/2010 as a dependent of post study work visa holder (partner-Husband) and living continuously in the UK since (15/02/2010)

On August 2010 My partner switched to Tier 1 General and my (PSW dependent visa) status was changed to dependent of Tier 1 general until 03/04/2014

On 10/03/2014 My partner got Indefinite leave to Remain on Long Term Residency basis (10 years)

On 03/04/2014, my visa (Dependent of Tier 1 General) was changed to spouse visa (2 years) dependent of a person who is now settled (ILR) and present in the UK

Since i have already spent more than 2 years as a dependent (Dependent of Tier 1 General) , therefore my kind questions are as below

1. Can i apply for Indefinite Leave to Remain in the UK any time now or i have to wait and complete 2 years qualifying period from the start (03/04/2014)?
2. If yes ! do i need to show any maintenance funds?

Hi Guru Raghav,

You are correct that "Absences must be for a reason consistent with the original purpose of entry to the UK". You have to also take the 180 days requirement into account.

Calculation of the continuous period in the UK (page 19) - "No more than 180 whole days absence are allowed in any of the five, four, three or two consecutive 12 month periods, depending on the category, preceding the date of the application for indefinite leave to remain (ILR)."

You will be eligible in 2010 June + 5 years = 2015 June

When was your first Tier 2 (ICT) granted and for how long was it valid?

If it was a fresh application, then the Tier 2 (Intra-company transfers) (ICT) granted under the rules in place before 6 April 2010 (paragraph 245GF) cannot unfortunately apply.
